Got Refusal Letter :(

Hi everyone ,
Can any one Help me in my case?
My spouse got a refusal letter that state that "The documents and some forms they asked to my spouse to send ,Islamabad Embassy did not received while my spouse had been sent documents to lawyer and Lawyer sent to Islamabad Embassy . and they also mentioned in letter that they sent reminder of not getting documents to Lawyer. Lawyer says he did not received that letter. I am giving some details below.
Applied on Feb 2011
Got approval march 2011
requested more doc on 18 April 2012( marriage cert+photos+bankstament+emails+letters+gift receipt+...)
papers sent on 22 june 2013
med request 15 may 2012
medical done 02 july
refusal letter received April 10,2013(reason they state in letter ,they requested documents on 18 April ,that not received to Islamabad Embassy and resent ,letter on Jan 2013 ,they did not received again while lawyer didn't get any reminder )
and April 10, 2013 they sent refusal letter .

I really don't know what to do ?
I contact to lawyer , he said, he had mailed to embassy and embassy said not received ,and Lawyer also says the reminder letter of 3rd Jan 2013 also did not received to lawyer . I have filed appeal on 15 Apr 2013 .what is the chance of ADR or court hearing? what is the expected waiting time of Toronto , if either one I get ADR or court hearing? what could be the output of this case. And
Change of lawyer would be good decision or I should keep same ?
Plz if any one can help me ? I will appreciate your reply.

I am really sorry for what has happened in your case.
I would look this at 2 angles.
And this is my personal opinion , so think wise before you act on it.

1) Order GCMS notes and see exact dates when letters were sent from CIC as they claim.
2) Change the lawyer. In your case I personally feel the lawyer wasn't careful enough to follow up with CIC via email/letter to confirm your packet has reached CIC also aware from the CIC case enquiry that a new letter CIC has been sent from CIC.

Does your lawyer not have proof of delivery to the embassy? Any lawyer worth their salt should send documents via tracked mail or courier and keep meticulous records of them. If they do have proof of delivery, then the embassy may allow extra time to resubmit the lost documents.

This communication issue is just 2 much , in this day and age - the embassy uses regular post to mail important paperwork. In my case, it was incorrect email ( even after correcting it ) and 2-3 others in parents case where they sent paperwork and it didn't reach them. There is another user who had his app refused as they never sent paperwork but they never got it

Firstly, they don't reply on time, no do they reply to faxes and on top no way to track anything

Its pure bad luck, order GCMS notes ( see my sig ) and see what is says under OUTGOING - keep emailing them and ask the details of the address etc

PS. - Embassy does attempt to call as well ( at least you hope )

I think what may have happened in your case they asked for additional documents on April 18th, they usually only give you 60 to submit those documents and you are saying you sent them in on June 22nd which makes it more then 60 days.....look at the letter they sent you on the 18th of april and see how long you had to submit them.

But, Letter issued on 18 April from Islamabad and mailed from Mississauga on 4rth May to my lawyer and my lawyer received letter on 14 May, lawyer mailed my docs on 22 June , Lawyer already made extension. I think Its not a matter of time, they totally says they did not received my documents. From 18April to 3rd Jan they waited for my documents and on 3rd Jan they resent me a letter and this 3rd Jan 2013 's letter my lawyer did not received.

The date that is on the letter, is the date those 60 days start. So, it will be from April 18. So yes, you missed the deadline. Also, I may have misunderstood, but your lawyer does not make extensions, only CIC can.
