Going without kid and wife

Hi All ,

I have a particular situation.

Timeline :
June 2016 : Received PR
Oct 2016 : Soft landing (10 days)
PR cards expiry : Nov 2021

Family : Myself , Wife and 3 year old kid

Scenario , There are around 900 days remaining for my PR cards to expire and I need to be in Canada for 730 days before nov 2021 to renew my PR. Now we are planning that only I go to Canada and my wife and kid remains back in India for next 2 years. I will renew my PR card after 2 years of stay and at that time the PR cards of my wife and kid will expire as they will not be able to fullfill minimum stay requirement.

Questions :

1) Can this arrangement be a problem during PR renewal or applying for citizenship ? ( as to why your family did not accompany you in Canada ?

2) Can I apply for citizenship after 3 years of stay (alone) ?

3) Will i be able to bring in my wife and kid anytime in between if I want to ?

4) If yes , will i need to file application for family sponsorship ? what will be the processing time for this ?

1)and 2) PR status, residency obligation and citizenship application are all at an individual level and not affected by your family status. They are responsible to meet their own obligations.

3)assuming your family PR cards expire 11/2021 then sure they can still travel on the understanding that if on any entry it is determined they have not met the residency obligation the process to revoke their PR status could be started. There is no way to predict whether the revoke process might be started as just depends on the CBSA officer at the time although as PRs they would still be entitled to enter.

Once their PR cards expire they would need to apply for PRTDs which could also result in PR status being revoked if residency not met.

Once their PR status has been revoked or renounced it might be very difficult to get TRVs approved given they would be assessed as visitors with a relative , you , in Canada probably making ties in home country a requirement of any application to show would leave Canada.

4)spouse/family sponsorship is currently quoted as 12 months although often less than this

Once you settle with the job then try to apply for PRTD for them based on H&C grounds. Mostly they would give it as you are here and applying to bring them.

My neighbour had this problem and then they applied for PRTD and received.

If not successful then bring them using the existing PR cards and see if it works as they can explain the officer and its possible that the officer might let them in without reporting.

If officer reports then anyway they would meet the judge to decide on revocation and you can still request for approving it as you are here and having job to support them.

Worst case, you might need to apply from start.

Bringing them wont be a major problem than your settlement first to support them.

But wont you able to get them this year once you find a decent job to avoid these headache?

This case doesn't seem to have any grounds for H&C. Why wait 6+ months to apply for prod under H&C only to get refused and start again. The wife and child can try entering with their valid PR cards and see whether they get reported but if their PR cards are expired the OP should either try entering via the uS border or renounce and sponsor again. Lots of things to consider because depending on the province you may not be able to access healthcare and education.
