Getting married, help needed

Hello friends

I am not very active on this part of the forum. I have secured a PR and would land in August 2016. I am single and there are various thoughts creeping my mind on applying for a spouse visa. I know, if I get married now, I need to inform CIC and they will issue us a new COPR and immigrant visa to me and my spouse. This will again take time and I would want to avoid this. ::)

Supposedly if I get engaged now, do I need to inform CIC about it? Post engagement, I apply for tourist visa (TRV) for my fiancee.

Now I have two situations -

1) I come back after six months and get married in India. Submit all the documents to NVDO for her PR visa.

OR

2) In the meanwhile, after getting married she joins me in Canada on a TRV. After landing, can I submit the spousal application in Canada Visa Office or I have to compulsorily submit it at NVDO?

Which would be the best option for me? Can someone please guide. Any help is much appreciated.

No - you don't need to notify CIC of an engagement.

1) PR applications are submitted to the Mississauga office first - not NDVO. If you get married in India and then wish to sponsor her outland while she remain in India, you will first have to return to Canada and then file the application once you are back in Canada. You will have to remain in Canada while her application is being processed (short trips of a few weeks outside of Canada are fine).

2) Yes - provided she is able to obtain a TRV, she can come to Canada and you can sponsor her while she is here. Again, all PR applications are first submitted to the Mississauga office.

I have seen many cases like yours. Ppl regret not getting married before landing and adding ur spouse on initial COPR. Much much quicker. If u get married later on ur spouse will be waiting in India for about 17 months after marriage.

TRV is a hit and miss. Don't rely on it.

Scylla - As you pointed out, if my spouse is with me in Canada on TRV post marriage and then I submit her application to Mississuaga office, it would be treated as Inland?

Also, I believe all the necessary forms and documents including photos, certificates are to be uploaded online like the same way we for EE using GCkey or needs to be couriered to Mississauga office?

rambopg - Yes, I completely agree with your suggestion. What does this 'TRV is a hit and miss' means? Is it difficult to obtain a TRV? Please expound.

No - applying from Canada doesn't make it inland. If you apply from within Canada you can pick either the inland or outland process. Which application package you select determines if it's inland or outland.

No - nothing is done online. It's nothing like EE. You should spend time on the CIC web site familiarizing yourself with the process.

There is no guarantee your wife will be able to obtain a TRV. To be approved, she will need to demonstrate strong ties to her home country and prove she has no plans on remaining in Canada long-term. If CIC believes that she plans on using the TRV to try to move to Canada before she has PR, the TRV will most likely be refused. There is quite a high rate of refusals for spouses of Canadians.

Thnx once again, Scylla.

Now that I have a roadmap on the process to be followed, I will deep dive to further get a perspective of the process.
