Hello,

I met my wife in 2008 in USA. We got married and we had a son. In december 2013 we decide to move back to Canada (she is Canadian) and our soon and me are under her sponsorship. Our marrige is on a very difficuld stage, and we talk about getting divorce. My soon and I, got the permanent resident 4 monts ago. I would like to know if we get divorce how this affect my status, and if exist the posibility to go back to my country with my soon.

Thank you in advance

Does your COPR list any conditions?

if you were married for more than 2 years and had a child prior to submitting your application, then more than likely you do not have condition 51. This would be listed on your COPR. if you don't have condition 51, nothing will happen to your pr status if you get a divorce. you would be free to continue your life in canada with no immigration issue.

if you do have the condition listed, then that means you must cohabitate with your wife for 2 years from the date you landed. otherwise, if she reports the breakdown to CIC, they can start the process to revoke your pr and you would need to leave. no one really knows how condition 51 is tracked, so if the breakdown is not reported, then cic may never find out.
