Hi,

I have been lurking for a few weeks. It has been 25 weeks since AOR. I had requested GCMS notes in August. I received a 106 page long document in September. I have uploaded links to page no. 2, 103 & 104 which I think contain the most relevant information.

I called last week & was told that there had been no change in my status & my file was still at CIO.

Can someone please explain the following:

1. What does HIRV on page 2 stand for?

2. What is the due date on page 2 for?

3. Page 103 says Review Required for duties but my lawyer has not asked me for any additional information. I work for a fairly large MNC with offices in several cities around the world. It is listed even on NYSE. I had provided an email from my manager & an affidavit listing my job duties. Is that usually enough?

4. On page 103 it also says A11.2 CRS Assessment: Appears Met which seems to conflict with Review Required for duties so what should I make of it?

Email is idle for Reference letter. You would have provided reference letter on Company letter head with detailed duties. In your case, Visa officer is awaiting detailed job duties from your Manager which are not being provided yet. This is what being mentioned on your notes.

If you are provided affidavit, you should have uploaded an LOE detailing about an affidavit.

The college where I worked has a letterhead with only name of the college, address, telephone number and fax number but it doesn't have any logo on it. If there is no website then Visa officer will visit your college for verification. There is no problem in that however the PR processing will take longer time. This has happened in the past.

Actually I am in the same case, as my LOEs didn't mention duties and responsabilities. The officer put my eligibility under review and my documents were set for review as well. I wasn't asked to sent any ADR but I raised a CSE last week and sent both LOEs with duties and an update of POF. They've sent to me an email saying that the documents were forwarded to the department in charge of my application, but I don't know if the officer accepted to open the file. I know that there is no more to do from my side.

What happens generally in those cases?Will they take a long time to finalize the case knowing that my AOR is 7 july?

My college has a facebook page and also the name and photos of college pop out when someone searches it in google/google map. Similarly, not having a college's logo on letterhead would be an issue?

HIRV stands for Human and International Rights Violation.

The due date is a system generated date. It has no relevance. In most cases applications are processed way before it and in some they keep sitting way past it.

Then it comes to duties, your duties listed in the reference letter should substantially match those off that of the NOC selected. If the analyst has concerns, it will be referred to the officer to make a final determination. It doe snot matter whether you work for a large company or a a small one. The job duties should match. If the NOC is incorrect or the Job duties do not match, you may receive a procedural fairness letter.

When it comes to work reference letters:
  • should be an official document printed on company letterhead (must include the applicant’s name, the company’s contact information [address, telephone number and email address], and the name, title and signature of the immediate supervisor or personnel officer at the company),
  • should indicate all positions held while employed at the company and must include the following details: job title, duties and responsibilities, job status (if current job), dates worked for the company, number of work hours per week and annual salary plus benefits
As long as you have the above covered, you are good.

More information about my company is available on the internet.

I have not received request for any additional information from my agent & the CIC agents I spoke with have also said that no additional documents are needed.

So seeing that I really cannot provide any more information regarding my job duties & the fact that it has been almost 6 months since AOR, what is the best course of action for me? Is it likely that my application is on course for a rejection?

My agent told me that I could submit an affidavit, an email from my manager & a copy of his ID card (badge) which I did. The email contains my manager's phone number & email address. More information about my company is available on the internet.

You can submit affidavit, email and copy of ID Card and also submit an LOE for job duties.

If you have submitted these documents already, you will get PR application. One of my client received his PR last year and his employer also refused to provide reference letter. and he did the same thing which you are doing.

Thanks @mr.preetsingh I did provide an email from supervisor with his designation, email & phone no., copy of his ID & an affidavit from court.

Could you explain what an LOE would comprise of. I did write in the affidavit that my company does not provide job duties on company letter head & attached another email from my manager stating this, do you think that might be enough?
