GCMS notes, Allowed to Leave, New Visa Application

Hey everyone,

I received the GCMS notes for my Fiance's file. We are preparing to apply for a new visa application as his application was refused in March of 2018 for a new multi entry visa. He was refused due to ties to Canada and his ties to his country of residence.

Because he holds a 10 year visa to USA, he does qualify for Can+ which means he doesn't require detail financial information. We were advised that it is best to detail our travel history together as even after the refusal we still traveled often and this would be best to show we have a legit relationship.

Here are my questions:

1. He attempted to enter Canada after accidentally leaving with his extension document. Because of this, it indicates "allowed to leave" on the GCMS notes. Will this pose a problem for his application and should this be addressed with an additional letter explaining?

2. part of his refusal was due to " ties to Canada" that would be his relationship with me. How do we overcome this in the new application or what would make this not be an issue?

3. The GCMS notes had an error which it indicated that his extension was for 4 months (to Dec 2017); however, the extension was till Dec 2018. This makes it look like he overstayed his extension on the notes which this information is incorrect. How can I address this issue on the new application?

4. There are notes that indicate that I had sponsored my Ex in 2010. I am concern that this information is looked at negatively. Should this also be addressed or it really doesn't matter.

Final Note: I am just looking for helpful tips to help his application here, not commentary about the obvious. I appreciate anyone who can help with my questions.

Thanks.

Seems like you are gathering information to show that your relationship is legit, that is something that is important for a spousal or common law sponsorship. For a TRV they do not care so much that your relationship is real but more so that the fiancé will leave at the end of the trv.

To be on the safe side, when it asks have you ever been refused entry, in that section you can explain everything. If its online you can scan more of an explanation letter. You can also mention the error in extension. Basically you have to address all the reasons for refusal and why the situation has changed so that those do not apply anymore. you would know best what the other refusal reasons were.
WIth respect to the ties to Canada (which is you) you have to show that the ties to the home country are stronger than Canada. Might be tough to do if you end goal is to get married and move to Canada. Ties to his home country would be property, children, job, etc. They deny spouses and fiances because the intent of a trv is temporary while intent of person applying is to stay in Canada long term eventually. When are you planning on getting married? In his home country?

It was suggested to show our travels together after the refusal to show it is legit as their assumption maybe it's a fake fiance situation to come to Canada. This isn't the case with us which is why it was suggested.

It's unfortunate that I told the truth about our relationship because now it's negatively impacting his TRV application.

He going to start his application for citizenship in the UK this is the reason why multi entry TRV works better for us. We have been looking at properties in the USA for vacation/ future retirement.

We could have gotten married many times over the past year; however, spouses have the worst chances of being approved for TRV. Since his kids have about 5 years before they are adults, we are in no hurry to have him settle in Canada right now( or ever). Plans for getting married is not in our scope right now; but, we share a committed relationship which is important to us.

So Basically, he can explain in the additional documents option online the refusal and our person situation?
