FSW1 or FSW3? which is better?

Hi All,

I can either apply as FSW1 or FSW3 but am uncertain which is more likely to be approved?
And which is processed quicker?

FSW2 AND FSW3 ARE MORE SECURE COMPARE TO FSW1.

FSW2 requires one year of study or work in canada and you should be present in canada right now. It helps to get more Adaptability points.

FSW3 requires a permanent job offer from Canadian employer. It is known as Arrange Employment. It helps to get more 15 point for Adaptability and Arrange Employment Category.

Please write complete details whether you have Job offer or you are in Canada now.

FSW2 and FSW 3 are the other way around... not a big deal but don't want others to get confused -

* Category 1: For persons in an occupation which corresponds to the list of occupations identified in the Ministerial Instructions and have evidence of one year of continuous full-time (or full-time equivalent) experience in that occupation;
* Category 2: For persons who have arranged employment offer with a Canadian employer; or
* Category 3: For students or workers who are legally residing in Canada, and have done so for at least 12 months immediately before submitting their application.

There's no evidence indicating that any one of these are more "secure" or will be processed faster. If you have been working in Canada for 2 or more years, take a look at the CEC program...

Dear Friends,

There are 3 category in FSW program.

There are 2 requirement in FSW1

1. FSW1 require at least 1 years of full time work experience under 38 Selected category. 95% people are not under 38 category so they will not qualify.

FSW2 and FSW3 do not require any Job under 38 Category.

2. FSW1 require minimum 67 points out of 100 points. 95% people do not get any points under Adaptability and Arrange Employment Factor, this 2 factor helps to get 20 Points. So candidate must score 67 out of 80 Points. It is really difficult to get this much score and they stop on border line.

FSW2 and FSW3 help to get additional points under Adaptability and Arrange Employment Factor.

Concerning FSW3 (Temporary foreign worker or international student residing in Canada for one year and still in Canada), I have 2 very important questions here:

1) is it strictly required that you must legally reside at 12 months in calendar sense? Or 11 months and a week can be round up to one year? My study permit will expire and I cannot stick around for a complete 12 calendar year or I will be violating the law.

2) After I have filed my application, can I return my homecountry to wait for the result? Will it disqualify me on the ground that I am not CURRENTLY residing in Canada?

You must have at least 1 year in canada on Study Permit or Work permit legally. Less than 1 yeas will not be accepted.

If you apply for FSW3, you must stay in Canada till decision of your visa. You can not come to your home country.

Hi friend, thank you very much for your clear answer regarding my FSW3 appliation. Because of its important significance, could you please also tell me the source of regulation/legislation that lead you to that conclusion? I've read through OP06 but didn't find anything about this issue.

Indeed I am not planning to return to my homecountry immediately after my filing, I can wait until the CIO's message. But I really don't want to wait for 2 years to wait the final decision. Can I return to my homecountry after I have received the initial process opinion from CIO?
I will appreciate your help very much, thank you!

I fall under both of them, and sent supporting documents to prove both of them. However, there was no any difference in the processing time or priority.

After i got my assessment letter, i found out that they treated my application under FSW 1 not 3 i do not know why or what would be the difference.

I have a question related to FSW3.

If I am a TFW here in Canada for a year already, but my job code is NOC C (not NOC A,B,O). Will I still qualify as long as I reach the 67 points benchmark?

Or is the FWS3 option only available for those living legally in Canada for a year under skilled professions?

NO
You must have worked in Skill Type O/A/B.
Skill Type C or D are not accepted for FSW1, FSW2 or FSW3.
