Hi every one.

I applied for immigration under Federal skilled worker class in July 2008, my medial is done 3 months ago.
Now Immigration officer is asking me to present "Reference letter from current employer", but I am unemployed and looking for field job from last year.
Further more Immigration officer also threat me to refuse my application if I fail to submit the letter. I am puzzled, as this is not the requirement for immigration in FSW class.
Can any body please steer me in the right direction, I am running out of time.

I have never seen this type situation before. This seems blackmailing.

Very Interesting. you surely can be unemployed now, this is life, nothing is permanent.

Since you are unemployed now, you have to let CHC know that in your reply. In addition I would advise that you get another reference letter from your last employer. This you can attached to your cover letter.

There is nothing wrong in been unemployed. The criteria is that you must have worked for a minimum of one year in one of the approved 38No ministerial list.

I don't think the VO was threatening you. Maybe he was just emphasizing the need for you to respond to his query.

It appears that the immigration officer is not satisfied enough with some or all of your experince documents which you have sent first. Either because of the lack and/or doubts about the job duties or working periods, that is why he is asking you to update these documents because if he was fully satisfied at first, your application would have passed this point and there would be no effect at all whether you are still working or not once you pass the eligibility review and be granted the points.


They might only ask again for updated police clearance, proof of funds, (new medicals sometimes) after an applicant passes the eligibility review and be granted the points. They do not ask for any documents related to the work experience at this stage unless any previous mistake in that regard comes to light.

Thanks for your replies guys,
I even discussed this issue with lawyers and spent money but it ended up with no results, my last employer was a call center, can I submit letter from them?
I did do paid full time work one year back home under NOC 2132, and are legally residing in Canada since 2008.
I can post/email the letter they sent me, if you think it is necessary for the solution.

Appreciate your suggestions.

Yes please copy and paste it here, and answer the following questions please so that i might be able to help you :

Your category FSW 1, 2, or 3. (based on which one of them exactly have you got the approval letter from the CIO)

Your work experience number of years and whether it was full or part time.

Your NOC which you used to claim work experience in your application.

Your work experience documents exactly (every little details) that you have sent to support your claim.

FS3, (what is CIO?)

Work Experience was paid full time:
July 2004- Aug 2006 Assistant Manager (NOC 2132)
Dec 2003- May 2004 Trainee Design Engineer (NOC 2132)
Research Assistant (NOC 4122) Sep 2007 -Oct 2009

and here is the Letter excerpt from Buffalo:

[We are unable to continue the processing of your application without " Letter of Reference from your current employer"
If you fail to provide the requested information, you may prevent me from being satisfied that, under subsection 16(1) IPRA, your landing and entry in canada would not be contraty to the IPRA and I may refuse your application. Please submit asap.]

Please get me hell outa here.

CIO stands for the centralized intake office in sydney nova scotia, based on your timeline (July 2008) and your category, your application did not go through the CIO department because it was mandatory for category 1 only until april 1 2009. Therefore, you have submitted your full application directly to Buffalo visa office and no initial assessment was made before they recieve your application by any other department.

Anyway,

Which documents exactly did you submit as a proof of your work experience and what information was included in those documents ?

Yes you are right my all document with application was sent to Buffalo, I sent original letters from my employer with their business card, the information included in those letters was, my job length, duties and salary.

could it be a mistake.Whenever you reply, make sure you do not sound rude and do not question their working.They would not question you unnecessarily or go against the immigration policies because they know if they do that there are people in the world who will sue them.

Be careful while writing anything.
