Hi I have received the following response from Sydney when i applied in jan 2009 .

we have received your applicaion for permanent residence in canadain the federal skilled worker class.


The minister of citizenship, immigration and multiculturalism issued instructions which were published in the canada gazette on november 28, 2008. These instructions specify that only applicants who have an offer of arranged employment, applicants who are legally residing in canda for a least one year as a temporary foreign worker or an international student, or applicants who have work experience in certain listed occupations are eligible to be processed in the federal skilled worker class. we have reviewed your application under each of these criteria.

Although you have indicated that you are an international student, you have not been legally residing in cnada for at least one year. you have not indicated that you are legally residing in canda for at least one year as a temporary foreign worker nor have you indicated you have an offer of arranged employment. Your application has therefore been assessed on the basis of whether you have work experience in the list of occupations eligible for processing. These occupations are identified by codes and described in the National Occupational Classification (NOC). you may access the list of eligible occupations at:

you have indicated that you have work experience in an ocupation with the following NOC code:2174-programmer. Question,

I have completed my 1 year stay as an international student as of August 2009. I have 2 year work experience before coming to canada as a programmer. Can i re-apply again by keeping the Code 2174.
I am confused with 0213 and 2174. 2174 IS NOT IN THE 38 OCCUPATION LIST. But as FSW CATEGORY 3 CAN I APPLY WITH THE CODE 2174. Please someone respond.
 
If you apply under category 3, it doesn't matter whether your NOC Code falls under the 38 list of jobs or not as long as it is still skill level, A, B, OR O.


Which documents exactly have you sent to the CIO and what was your situation exactly at the time of your application ? (i mean have you been studying at the time of your application ? or just a study permit holder ?

these are the documents required to approve you under category 3 as an international student :

copy of your student visa on your passport with the entry stamp,

copy of your first study permit and any extension for the study permit,

proof of attendence from the educational institution which you are attending states clearly the starting date with them and the expected graduation date, and copy of your transcripts.
 
Oh sorry i did not notice that you have just completed one year in August 2009, so that is why they refused your application.

can i keep the same noc code 2174?. I have 2 years of programmer experience before coming into canada..
also i got my study permit extension in september 2009. do i need to send it for stamping to buffalo before i send my application to sydney or study permit extension paper is enough..?

Yes of course, you can apply again, but make sure to send all of the documents which i mentioned above.
you do not have to stamp any thing from any department, just send photocopies of all of the above documents except the proof of attendence, it has to be original.

for the study permit, you stated that you have got an extension, it means that you have 2 study permits now the old and the new, send just photocopies for both of them. Don't forget the photocopy of your visa and the entry stamp.

what is cat A B OR C you mentioned above?

Yes keep it as is 2174 although it is not in the list, it doesn't matter because your are applying under category 3.

your NOC is level A
 
A, B, 0, C, D; mean the national occupational classification levels in canada which classify the level of any occupation, in order for any one to be accepted under the FSW he has to have at least one year of experience in level A or B or 0.
