FSW Backround Check ..Plz help

hi All .

I am Vivek from india. below is my current profile

B.tech in computers science and 5.5 years of exp. and i have cleared IELTS with 7 bands overall and not less than 6 in any module and as per evaluation i am having the eligiblity to apply for FSW with around 69 points .

Below are the major issues which is preventing me from applying.

1. I am currently living seperatly from my wife and divorce proceeding is going on in the court and my wife has filled the false dowry case which is 498a and also domestic violence case which is considered as criminal cases in india.

i know i will be required police clearance certificate later on may be after 1 year of filling the immigration application and i am hopeful till that time my issue will be resolved .

But the question is that while submitting the application for immigration now there is backround verification form in which it is required to disclose any pending criminal case which is going against me .

my question is .. Do i required to disclose my case details in the immigration form to avoid any issues later on or i can say NO to it and my the time of police clearance certificate submission my issues will be resolved .

please advice .. i am in great confusion .

i suggest declare whatever is your current situation at the time of application.

Suggest to declare it, which demonstrates integrity which is one of the core requirements of Canadian immigration.
there is a good chance that the '498a wives' may send the case details to husband's employers and immigration authorities.. after all they look all possible avenues to damage husband's life.
Not declaring could lead to 'Misrepresentation" at later stage and PR could be revoked. It may also impose 3 year ban.

I am in the same boat. Checking with immig. lawyer how the 498a and DV could be appropriately represented to CIC, given their false nature.
