FSW backlog question

What is the status of an application that was returned during FSW pre-2009 backlog? Is it rejected or some other status? When a person whose application and fees have been returned is reapplying for immigration do they answer YES to Question 6d (previously refused immigrant/PR visa) on IMM 5669 background / declaration and state that they were part of the FSW pre2009 backlog?
