FSW application with visa and passport expiry(being held by UKBA to extend visa)

Dear all,

Can anyone help me by providing specific information relating to the following matter.
I have the opportunity for FSW . I have been living in uk for the last 5 years. My and my husband's passports are in UK immigration department now (UKBA). My husband send the application to UKBA 6 months before to switch the immigration category and refused. However, he appealed against the decision and now it is waiting for hearing. In the meantime his passport date and visa dates are expired and it is still with the UKBA. But UKBA still did not make any decision on my application as spouse. My passport expiry date is totally fine.

We have all the letters Like, Acknowledgement of the application, Biometrics letters, refusal letters, appeal letters, solicitor (Lawer letter of the legal status). Point assessment for fsw has been done and scored more than 75 for both cases( me and my husband).

My specific questions are:

1. As my husband passport expiry date is outdated and UKBA do not give the passport back for renewal until the final decision has been made, is that ok he submit the passport copy (though the expiry date has gone) with UKBA and solicitor letters,

2. As his passport date is expired, he might no be able to submit his police certificate form UK. However, this can be done once he get the passport renewed.

3. We both have got police certificate form UK and our own country dated one year before. Are those be any help.

4. As we are afraid of the rapidly changing nature of the immigration policy of Canada, and we are really focused to move to Canada, we want to submit the application as soon as possible. Is it ok we apply now and give the UK visa extension paper, police certificate later ( may be by 6 months time)?

5. We have already done our notary of all documents one years before while we were preparing for FSW. Are they still valid? Or they have to make their document notary again.

Please, give me suggestion on this matter and notify me if there any specific guideline on those circumstances.
