From India or from Canada?

Dear Seniors,

I have a question. I am in process of applying through quebec for immigration from India in a month or so. Also, while this process is on, I want to go to canada and start studying with my family (wife and kid). I am thinking will it be better for me apply now for immigration from India and go there on a student visa? The reason is Immigration from India will take time and I want to use this time. Or should I go there on study visa and then apply for immigration from Canada itself?
Your thoughts will be greatly appreciated.

If you apply for PR before a student visa, it will be very difficult to convince VO of your INTENT to return to homecountry after the specified time period of your study.

You have to show strong ties with home country in order to convince VO for a Student visa and with a PR application in process the INTENT to return does not hold ground.

Canada allows DUAL INTENT but more so for a PR applicant rather than for a student.

Apply as student first, once you reach there its better then to apply for PR. If you apply for student visa after PR application - as Mitali explained it will be rather difficult to explain to VO your intention.

Actually, i am in a dilemma, as I do not really need to study anymore i am already an MBA. The problem is PR is such a long process i do not want to be like too old when I actually go there to work and then getting work under bosses who are like 5 years younger to me.

So, I was thinking may be I go there first and then apply for a pr. If i do an 8 month course then I can at least go for a 8 month work while I work out something for the PR.

Hi Mohan,

This mindset has to change friend.....there is no age for going back to college irrespective of what degrees you have already acquired and what your age is. ;) "Working for younger bosses"....you may have no option but to work under them.....it might be fun....you have to have an open mind.

Student visa will not be granted if the course is less than 6months. Best option for you is to come on a student visa and work your way for PR application. You will also acquire the required "Canadian experience" if you got some Canadian education.....worthwhile. :)

Hi Mohan,

Missed this query....

Processing times for PR will not get any preference if applied from within Canada.

You have to judiciously select your VISA OFFICE. If you want to apply for PR when you are residing in Canada then you will have 2 options to choose from for your Visa office....that is ...Buffalo or NEW DELHI. If you chose Buffalo as your VO then you will have to maintain LEGAL STATUS in Canada till the processing is over.

Also, one more thing buddy, I need my wife and 1 kid to be with me while i am studying in Canada. Should i apply all the visas at the same time and then call them later? I would ideally want them to come with me really.

You suggestions are very much appreciated?

Your visa office would be buffalo till get stamp your visa on your passport, example : at the end stage of passport submittion if you will not in the canada than you have to submit Passports for stamping in Buffalo VO at this stage you can not transfer your visa office to india (you can submit passport by visit yourself like enter back on turist visa or you can submit by any relatives or friends with written authority letter that he/she carry your passport for visa stamping purpose only and same way you have to get back if you are not in Canada or if you not plan to submit your passport at buffalo in person).

You will have to extend your stay before the valid Permit expires.....you can either extend it as a STUDENT PERMIT - for this , you will have to show all the requirements, like admission to another course, letter from the Institution confirming your candidature and payment of fees OR you could extend your stay as a VISITOR again ou have to provide appropriate reasons......applicants just mention that they are interested to tour Canada as a visitor, generally these visas are granted for a 6 month period unless you ask for more and also show finances to support your self for the period requested for.

Also, one more thing buddy, I need my wife and 1 kid to be with me while i am studying in Canada. Should i apply all the visas at the same time and then call them later? :)This is risky...and most of the times such applications are rejected because it will be difficult if not impossible to convince VO that they have strong ties back home esp because you will be residing here I would ideally want them to come with me really.You can apply for them along with yours and have to deftly draft your letter to indicate that they will stay for a while, visit Canada and be back to home country after the specified time period.

It will go against you if you applied for their Visitor visa after you apply for PR....that is a straightforward rejection

One can have his homecountry or the country of his current residence as is VO if he has been admitted legally for a year.

So if Mohan gets a visa for Canada for a year, then he has a choice of 2 VO- Buffalo or NDVO.

Now if he choses Buffalo as his VO and he has to go back then as you said , his FILE WILL NOT BE TRANSFERRED TO NDVO. He will be stuck if he is called for an Interview at Buffalo.....as US Immigration does not provide tourist visas that easily and esp to attend an Immigration Interview.

Mitali, Omm, Many thanks for your help. I am getting more general help here than I guess any immigration consultant can guide.

I understand your points and the fact that I may not be granted a student visa after I files for PR (quebec) from my home country, the only problem is the time.

I am yet to get the admission, and the course will start in september, october times. Till then I have this almost whole year which I could have used against my PR. So, when i go there as a student i do not have to worry a lot about it because I would be ahead of the race. By the way i intend to apply for the PR from the quebec process.

Very strange situation this is, as you never know by the time I am there they close the routes available for PRs. Or something changes and I have to come back home.
