The first generation limit to citizenship was ruled unconstitutional, but is currently stayed until August 9th in which time the government must come up with new rules regarding constitutional exceptions to replace its current interim rules. The court found that granting people with automatic citizenship inappropriate, and hinted that all applications should be prioritized regardless of the narrow interim measures the IRCC came up with.

I applied for citizenship by descent for my daughter born outside of Canada on June 17th from my local consulate. I asked for urgent processing and a constitutional to be granted. My basis for a constitutional exception was the ruling extending the stay documenting the ongoing harm against delaying citizenship, my ability to run for political office and participate in the 2025 elections, my daughter's age (2) being a factor in being able to natively learn French (family is Quebecois, but we are anglophones), and my own ability to access healthcare. These arguments probably wouldn't be so persuasive for the published interim reasons, but given the judge's ruling I think it is sufficient, especially the language argument. This one is serious to me as father trying to raise a multi-lingual child.

I am fully expecting this to be handed off the the Program Support Unit and to be done in February or March of 2025, but there's nothing wrong with asking for urgency as the arguments are sound. The IRCC should not be processing temporary visas faster than proof of citizenship applications. I understand that some cases are complex and need additional time to work through (mine included), but there needs to be a systemic shift in the way Canada does business. This is why I am planning to parachute in for the 2025 election and canvass for the candidates I support. I would love to end birthright citizenship as a matter of principle. It's not ok to prioritize PGWP people over those whose families helped build Canada into a wealthy nation.

I think there's a lot of talk about who Lost Canadians are, and what values we have. I have a great deal of respect and gratitude for some individuals in the NDP and Labour, but left wing we are not.
