Found an error from GCMS note - working hours issue

Hi all CEC candidates and experts!

I am a Feb 2014 candidate who is still waiting and waiting for a request of medical exam..
I got my GCMS note today and found an issue about experienced working hours.
According to GCMS note,
ASSESSMENTS
Eligibility: In Progress
Security: Not Started
HIRV:
Criminality: In progress
Org Crime:
Medical: Not started


Someone wrote this in Aug 2014 and said:
Work experience 02NOV2012 to 31OCT2013 ..........
The PA does NOT have 1-year of skilled work experience in a NOC 0,A or B occupation and therefore
does NOT meet the requirements under the applicable regulation.
PA submitted paystubs. According to the calculated dates, PA has a maximum of 1,530 eligible hours.
.................RECOMMENDATION: REVIEW REQUIRED BY OFFICER OTHER CONCERNS:
Appears PA is 30 hours shy of being eligible for CEC.


So I have double checked my paystubs and added up all work hours again and it's 1813 hours in total, which is enough.
An officer didn't calculate the working hours correctly and now it seems delaying the process.

Before I received this GCMS note, I also received a reply of my current status request by email that no action or document is needed from me for now.

Should I just wait or should I let them know to recalculate the working hours?

You should resubmit documents that clearly shows your total hours just in case- because from what the GCMS note says, you could be rejected

At least that's what I'd do, unless getting the paystubs/work experience letter is a huge hassle

Hi,
I think there could be a problem with your work experience which was from 02 Nov. 2012 to 31 Oct. 2013. It seems you had not finished 1 entire year of work. You have to fulfill both, the working hours as well as 1 complete year of work. Of course you can point out that the working hours calculation done by the VO was incorrect.

They don't count the hours from paystubs, they count by (how many weeks during that period x 30 hours) even you work more than 30 hours a week.

This is what I notice from my GCMS notes, and they gave me a "recommend passed".

Did you have the same issue(lack of working hours)? Have you sent any docs regarding this issue?
How long have or had you waited to get a recommended passed? May i ask your CEC status? Sorry for the many Qs 8)

I dont have any issue with my hours, since I have 52 weeks x 30 hours experience.
I am a June applicant and I got my recommend passed in Jan.

working hours don't based on pay stub , if you are not a full time worker for the whole period, you need check the partial work hours in each week, not all the hours can be added. e.g you worked 24 hours for certain day, but not 24 hours will be counted as work experience. there is a max value for them .

OP, can you provide more details about your qualifying experience? It seemed that according to the gcms, you might be short by 3-4 days of full-time work. There could be any factors:
  • Excess hours don't meet the 52 weeks full-time requirement (at least 30 hours each week)
  • Periods of self employment, unauthorized work, work in ineligible occupations or full-time study while employed (Coop & OCWP)

If you want to use the "add up hours" method, note that you can only add a maximum of 30 hours per week.

30 hours or more is simply "full time", you do not count the hours, it is simply a full-time week. The equivalent (if you are adding hours) is 30. Doesn't matter if you work 40 or 60 or 80 in one week, you can only count 30.

The hourly equivalent is only given for those who work part-time... for example, if you have weeks with less than 30 hours...

I've applied CEC based on 02NOV2012 to 31OCT2013 as a full time worker(NOC: B 121) 35hrs/week from only single company. This work preiod is exactly 52 weeks. Not sure why they are missing a week and it says 30 hrs short.

That's one of the risk if the no contingencies of few days of work are added to ensure a smoother application. When the hours declared are not the same as the hours accepted by the VO, the application could run into trouble. Have you checked on your paystubs, if you have less than 30 hours on any of the week? Did you take time off for vacation or call-in sick?

How visa officer does know our working hours weekly wise or biweekly wise?

For Example

1st week 40 hrs
2nd week 21 hrs Tottaly worked 61 hrs.

If eligible hour is 60, weekly eligibile hour is 30 , working period is 2 weeks,

You are eligible asper total hours. But not eligible asper paystubs because , in your 1st week only 30 hours will count and in your 2nd week not eligible by below than 30 hours

My question is how vo know our working hours as details in weely

please explain expers

It is possible that they would not know. And since paystubs were not required, you can draw your own conclusions.

In that case, the VO would go by the information in the Letter of Employment, and cross-check that with your T4. As long as it's reasonably close, then it would be accepted.

Example: Your LOE says you work 35 hours per week and earn $20 per hour. So 35*20*52 weeks = 36,400 annually. That roughly matches your T4, it's good.

But - keep in mind that the VO could later request the paystubs. So it is in your best interest to calculate your eligibility correctly.

Salary/wage is a required detail in the Letter of Employment. Unlikely that a VO would approve this without verifying wage/salary information from your employer.
