I need help to protect myself.

A girl under a working visa, working as a live in nanny has tricked me into getting her pregnant. She would not take the morning after pill and would not abort either. After finding out the baby will be a boy she now regrets keeping it.

My issue is this, she lied to me and doesn't have a PR. She kept saying she would get it, but never has. She's not a skilled worker. She has said if I don't stay with her she won't give me custody of the baby. I want to be in the babies life and want custody.

What can I do to protect myself?
What can I do to ensure she doesn't steal the baby?

My huntch is that she just wanted to have a baby in Canada so she can stay in Canada. I believe her long torn objective is to ship the baby back to the Philippines so her family will watch the baby. I need to ensure that the baby does not leave Canada. How can I do that as well.

Is there ways of reporting her? I feel what she has done and is doing is absolutely wrong.

Maybe consult a lawyer for professional advice not a public forum..

Someone who is not a PR having a baby in Canada does not change their status, the baby might well be Canadian but the mother gains nothing and would need to qualify herself for PR or leave the country once her work permit has finished.

What about her threatening she won't declare me as the father? If the baby is born in Canada does it automatically get citizenship or does it need a Canadian parent?

Also, I need to ensure the baby is listed on the no fly list so she doesn't steal the baby.

The baby will automatically be a citizen if it's born in Canada.

She will need the father's permission (your permission) to remove the baby from Canada.

You can't add a baby to a no fly list. Agreed you should meet with a Family lawyer to discuss this situation.

Actually I did some digging and you can get a child on a no fly list. Well a list which prevents them from getting a passport.

child doesn't necessarily need a Canadian passport to leave Canada. I guess no custom counter for departing passengers, correct if I am wrong. Even if custom check exist at that point, people may hide their Canadian passport in the pocket and show a foreign country passport (dual nationality). If you are legally child's father, you may be able to prevent him from getting Canadian passport.

But if a child/baby is leaving the country doesn't it need a passport? I mean if she tries to go back to the Philippines won't they do some checks, because this seems a little common.

I know it's a hard situation, but don't forget she might not have any other choice than leaving with the baby if her Visa expires. And she is the mother. Just because you are Canadian you don't have more rights. Most likely the baby will be dual citizen. Best would be talk to each other and understanding the other's perspective as well. If it's not working, find a family lawyer. And please don't be mistaken, you both have made this baby. Telling a story absolutely one-sided and blaming exclusively the other party is not too fair and never covers the complete story. I honestly wish the best for all of you.
