Hi,
My wife traveled to Toronto, Canada (from India) in first week of May 2018 on Temporary Resident Visa and it will expire in April 2019. She did not get any stamp on her passport from the immigration officer post she reached to Toronto. Can someone please help me in knowing till when she can stay here?
If that's 6 months, she should go back by November first week. But we also traveled to U.S. for a week in September 2018 (on travel VISA) but again when we came back, she did not get any stamp on her passport while entering Canada.
Can someone please suggest if she can stay for another 6 months starting from September 2018?

I was not aware of this 6 months thing earlier and recently was being told, so would appreciate a quick response here. Please confirm!

Does her visa say single or multiple on it in the upper left corner? It’s quite likely CBSA didnt grant another 6 months after the US entry if there isn’t a new stamp. You could apply for an extension, but if the TRV is single entry, 1 year visa it is probably a test to see if she will comply with the requirements.

It says Multiple entries.
Should I apply for Extension? Only a week left before she completes 6 months, so should i have to send her back to India or can she stay here while extension is in progress?
Also, would there be any legal proceeding done if we do not apply for extension within 6 months? Anyway, we have to go back to India by end of Dec 2018, so what do you suggest me here?

She can remain in Canada on implied status, providing IRCC receives the extension application before the 6 month date of entry. No legal proceedings $100 application fee is cheap insurance to ensure she doesn’t overstay.
