Hi everyone,

Does anyone know if you can flagpole for open work permit while waiting for restoration of work permit status to be approved? I am from Visa exempt country. I do not understand how this process works.

You need to have a valid status if you want to flagpole, so you cannot do it, as you mentioned you have applied for restoration, that means you are out of status..

My understanding is that if you have a visitor visa, that is considered status in Canada? So if you are from a visa exempt country and do not need a visitor visa to stay in Canada, how do you otherwise obtain status?

As a visa exempt visitor, you are allowed into Canada for a fixed period of time. If you want to stay longer, then you apply to extend your visitor status using the exact same process as a non-visa exempt visitor. If you stay longer than allowed and fall out of status and want to fix this from within Canada, then you have to apply to restore your status and extend your visitor status in Canada.

If you have a valid study permit, work permit, or visitor record, and you leave Canada and visit only the United States, you do not need a valid temporary resident visa (TRV) to re-enter Canada. (See the Immigration and Refugee Protection Regulations, Part 9, Division 5, Section 190:3f). This also applies to visitors, provided you return to Canada by the end of the initial period authorized for your stay in Canada (typically six months or less).

Well staying in Canada isn't really his concern at the moment. He is allowed to stay in Canada while his application for restoration is in process, however the problem is the fact he cannot work. So that is why I was wondering if we could flagpole to claim a workers visa.

Do we need a US visa to flagpole though?.. i understand we dont need one to come back to canada.

Hi Everyone,I was here in Canada on single entry visitor Visa.During my stay I got a job offer from an Employer but in between that my visa got expired. I applied for extension but application got rejected.I applied For Restoration status with LMIA number in the application and its been 3 months and 21 days that I haven’t got result .I am told by my Lawyer that at the moment I am on implied status so I can go at the flagpole to get Work permit.
My question is Can I go at Flagpole for work permit on Implied status as I have filed Restoration or I have to wait for the extension of my Visa.
