FLAGPOLE WORK PERMIT UNSUCCESSFUL - PLEASE ADVISE

Hi everyone,

I would like to share my story about flagpoling and I am looking for your help.

I am an open post-graduation work permit holder. In March, I decided to undergo the medical exam in order to remove a restriction from my work permit. I submitted my paper application to Alberta. Shortly after, I learned that I can flagpole this change to my permit which I confirmed by calling CIC. So I decided to withdraw my paper application.

Yesterday, I went to the border (I did all the steps properly, US rejection etc.). Then I explained to the officer that I wanted to change my permit - I had all the documents with me.
She said she will not be able to do it. She stated she can only change permits issued at border and my work permit was issued in Alberta. She then went to check with her superivsor - and came with the same result. I do not understand it - I read everywhere that I can do it at the border, I showed her an email from CIC outlining this process as well. It was still a NO.

I called CIC today and asked them if they could still keep my application active. A very nice representative told me he will put a note on file but cannot guarantee it will be processed.
I need my amended work permit prior to September and cannot submit another application - processing time is now 4 months.

The CIC website says the online application takes only one month, however, when I go through eligibility questions - there is no way how I can choose that I have a open work permit and it does not give me the option to start a work permit application. Is there any way how I could get around this?

I am travelling from Europe to Canada in summer again so I might try applying at border again. I just really don't know what went wrong yesterday and why they could not issue the document. Has anyone experienced a similar thing?

I appreciate all the help you can provide.

In March - it is in the system - that was confirmed by CIC Call Centre as well.

The officer at the border told me they cannot issue the work permit at all. Which seems to be very untrue...

Ah - OK, so that wasn't the problem.

Maybe you can submit application online? Online work permit applications are processed very fast recently.

Unfortunately, open work permit holders can't apply online as we cannot pass the questionnaire - if I reply according to my situation, it does not allow me to create an application online...

Am I right that the new work permit should have been issued to me at the border? Is there any written law? I am willing to retry but want to be sure that this time it will happen.

not accurate, my representative applied online for my open work permit and TRP at the same time. How she did it. Not exactly sure, but I believe she uploaded it using her portal to CIC

I will confirm with her and let you know

Yes, I was able to apply online for my initial open work permit as well. Because you choose that you are student and it gives you the option to apply for WP. But if I choose my current situation is worker (I currently do have a permit) it doesn't give me any options

Hi Sitareh

can you explain first what kind of work permit you had? you mentioned some restrictions on it ,by that i guess it was closed work permit ,right?
and now you are trying to get open work permit

Can you please provide some low level details here? type of WP,forms used,options selected etc

i always renewed my permits online and did not had ever any issues(in case of complicated situation i wrote letter of explanation to clarify a particular situation)

Your right, I wasn't able to apply online had to submit paper application.

For some strange reason CIC website won’t allow to upload WP and TRP at the same time. Even though before it was okay according to my representative. It also don’t mention this anywhere in CIC website, so I believe it a technical error from immigration end.

There are certain things not very clear from the description in the thread.

You can always apply for work permits online.

If you are already a student, you are not applying for a new permit, you apply to extend your status as a student / worker or visitor.

Amendments to work permit is a separate process. Has a different fee and is not the same as applying for a new one.

You sound like asking for an amendment in the above description.

One can apply for a new work permit at the border if you meet the conditions of it (if you require a visa to enter Canada you have to have a valid work / study permit and must be returning from US only - meaning flagpole). Also the work permit types requiring MEDICALS when you are in Canada are NOT processed at the border.


Normally applications to extend work permit from inside Canada do not require medicals. If you are applying for a particular situation which requires medicals, then likely it falls in the same category that is not processed at boder.

You cannot get an amendment at the border.

What was the restriction on your work permit that you were trying to fix?

To the last point above from @Ottawa-applicant. TRP (Permit) is a completely separate document, a permission to some one not requiring a visa to enter Canada but banned for some reason such as DUI etc.

I presume you meant TRV which is processed by a separate visa office in Canada as opposed to work / study permits.

The standard requirement nowadays is that you have to apply for each (and pay) separately. First you apply for study / work permits. Once you have a valid one - you apply for TRV online which takes like 2 weeks. It even says in requirements, you have to have a valid study / work permit.

P.S. I have done all of those - via / without lawyer a few times, before becoming a PR.
