Flag Pole, LMO, Job Offer and...

Hi.

My Working Holiday visa was valid until the end of December 2012. Two weeks before I sent online application for "Visitor's Visa" (I paid 75$). I stoped working.
Meantime I found employer (Big Trucking Company) which have LMO and Job Offer for me.

1. Do they need to put my name on LMO or they just can give me one of their LMO's with Job Offer? Is it OK if my name is only on the Job Offer?

2. Can I just go to POE to do Flag Pole? My "visitor's visa" application is still in progress. Is it necessary for me to pay for restoration? Can I pay for restoration at POE? Can I pay there for everything like visa's processing fees etc.?

It's urgent case and I don't have time to wait for online processing times.

Anybody? I'd like to go to POE as soon as possible...

1. I have LMO called "Confirmation of unnamed labour market opinion".
2. I have Job Offer signed by manager with today date.
3. Like I said before I had IEC Working Holiday Work Permit valid to Dec 27th 2012. On dec 18th I applied for changing status for Visitor (I did it online - 15 days left to process). So if I think correct I am now on "Implied status", yes?

Can I go to the border do this flag pole and apply at Canadian Immigration Office there?

What about restoration? Do I eed pay for it or is it ok if I wait for "Visitor's status"?

- You do need an LMO with your name on it. An unnamed or open LMO plus a job offer with your name isn’t enough.

- As PMM mentioned in another thread, if you don’t need a medical, then you can flagpole to get your new work permit. Take along a copy of your visit visa application to prove you’ve made efforts to keep your status legal.

- I’m afraid I don’t know if you need to pay for restoration of status, but I would think not, since you’re currently on implied status (waiting to hear about the outcome of the visit visa application). As long as you have implied status, you don’t need to restore your status. But if I’m wrong and you do need to get restoration, it’s most likely they’ll ask for payment at the border along with the WP fee, etc.

The OP doesn't have to have a name of the LMO, bulk ones don't have names. He doesn't need to restore his status, just takes proof with him that he applied for an extension.

Hi, I think you're referring to HRSDC's new(ish) practice of not putting foreign workers' names on the LMO, at least in bulk cases. If that's the case here, then you're right, nothing to worry about.

However, pultyn said explicitly that his employer has a "confirmation of an unnamed LMO". An unnamed LMO is a pre-approval. It cannot be used to obtain a work permit until HRSDC has received the worker's name and other details, and then issues a "named" LMO (albeit the names may or may not appear on the version the worker receives from the employer).

pultyn, can you clarify which kind you've received?

You are right. I have benn at the border and did flag pole. No problems on US side, got back to Canada and everything went well until officer tried to connect me with LMO. He couldn't find me in their database and sent me back home. He told me to come back when I'll be sure that employer correctly put my name on LMO. He added some notes to their system and told me that I'll get my worki permit without any problems. So now I'm waiting.... I didn't have to pay for restoration.

Too bad you have to wait a while longer but hopefully HRSDC will complete the issuance soon. Good luck with everything.

It varies, should be 3-4 weeks. If you find out when your employer sent the paperwork to Service Canada, then you'll have an approximate timeline.

They already have open unnamed LMO so the only thing to do is send my name and data of birth, In Alberta it takes 3 -5 days. I hope it's not gonna take more than a week! :-(

The paperwork I referred to is the "Foreign Worker Information" section on the LMO. Are you sure your employer has sent it in already?

3-4 weeks is the usual max, it really should be faster than that but it depends how much volume the office processes.

If your employer has a legitimate reason to ask for urgent processing, he can include a cover note to that effect. That could help speed things up.
