Hey guys,

So, the CBSA scheduled my departure date and all of the sudden Air Canada asked me to complete a "fit to fly application" my imm lawyer contacted my doctor to fill the application, my doctor said that I am not fit to fly and my lawyer has sent this application to the border officer along with the deferral application as well.

We will find out tomorrow whether the border officer will grant the deferral until my second H&C is approved or rejected ( it is already in process)

This is my second departure notice I receive from CBSA, but it is my first time receiving a fit to fly application.

Have you received it as well? If so, how did it go?
 
Somewhat dependent on why you are not fit to fly and whether there is concrete proof like test results backing up the reason you can’t fly flr example. It is extremely case dependent.
 
The border officer rejected the deferral ((( my lawyer is sending a stay of removal application to the federal court today.

Good luck. That's the right move on the part of your lawyer.
 
My lawyer is sending the application today to the Federal Court, he is planning to defend me in court on Friday ))) Fingers crossed! It will take around one hour :)
 
Hey guys, just an update about me, my lawyer is representing me in court tomorrow at 10:00 am

I do not have to attend to the hearing ))) wish me luck! The hearing will take around 1 hour!!
