File rejected under 0213, please guide

Hi,

i applied under 0213 as a network administrator with 4.5 years of exp in November 2009
yesterday i got the rejection mail, stating
" although this NOC code corresponds to occupations specified in the list, the main duties that you listed do not indicate that you performed the actions described in the lead statement and a substantial number of the main duties of the occupation as set out in occupation description of the NOC, including all essential duties, As such, i'm not satisfied that your experience corresponds to NOC 0213"

i have few doubt, please clear them out

1) can i re apply?
2) if i re apply what changeS should i make to my application
3) can i re apply immediately? wont they say that how come my job duties changed so soon?
4) if i apply for student visa now? will i be able to get student visa? or embassy will reject it, since i tried for PR earlier?

P.S. MY DESIGNATION DON'T HAVE MANAGER WORD, BUT MY COMPANY GAVE ME IN WRITTEN THAT I HAVE BEEN MANAGING A TEAM FROM LAST 20 MONTHS, THIS LETTER WAS INCLUDED IN APPLICATION

I think there is a difference between network administrator or team leader and IT manager.

computer networks manager title is there in 0213,

my designation doesn't have manager word, but my company wrote that i'm performing managerial duties from last 20 months

You can compare your duties with this sample from CIC:

Plan, organize, direct, control and evaluate the operations of information systems and electronic data processing (EDP) departments and companies
Develop and implement policies and procedures for electronic data processing and computer systems operations and development
Meet with clients to discuss system requirements, specifications, costs and timelines
Assemble and manage teams of information systems personnel to design, develop, implement, operate and administer computer and telecommunications software, networks and information systems
Control the budget and expenditures of the department, company or project
Recruit and supervise computer analysts, engineers, programmers, technicians and other personnel and oversee their professional development and training.

Lots of Indian companies wrote whatever you want.
you can apply for student visa , its seperate process then PR.

yes, explain everything means your role in depth, but should be meet NOC 0213 duties. you can get new experience certificate with all explaination about your job role.
I have 2pages experience certificate from my last 2 companies. and I explain everything in depth.

i think you should reapply once you gather evidence that you have enough experience to manage a team or department or project.
An org chart or reporting structure should help. I guess CIC looks for core management experience.
How about trying to get PMP certified before you apply again?

ur duties should match with noc 0213, it is not required to be a manager designation,,,, u should emphasize duties also in reference letter.

I need your input... I am kind of concerned about my experience letter. The only experience letter I will show to CIC - if I get AOR, is that H1B petition letter that my company sent to USCIS. My company's policy is not to give any detailed experience letter - only employement verification letter - which only has title, slary and date of employement in it.

The H1B petition letter stated my title as Project Manager, however it does not lists detailed duties. It states in a couple paragraphs my responsibilities as Project Manager in broader term - such as ..my role is to achieve a certain objective from initiating the project to working with various team including the development team and measuring and reporting the result to the whole organization. Do you think this will be sufficient? I do have BA in Business, MS in Administrative Science/MIS and MBA. I also completed Project management Training. What do you think?

I am also on H1B, I not submitted I797 , CIO dont need I797. one more thing you have employment letter when you hired your employer show your details to USCIS. no problem if your employer explain each topic in details, canada PR process is totaly different and not depend on USCIS.
CIO will never ask anything about your H1B to USCIS, thats why they not ask for I797. take my example I never submited I797 and got AOR from CIO sydeny.

Thanks OMM, yes I understand that you are in US and have H1B. Congrats by the way for your AOR. But, maybe I did not explain clearly..I already submitted to CIO, received on Dec 23. Currently waiting for my AOR............... My concern, if I get AOR and ready to submit experience letter to CIC Buffalo, that only proof/doc that I have as Project Manager, is that petition letter (I am sure you know what it is) that my company sent to USCIS for my H1B. My 0213 position was from 2005-2007, right now I am in different position (NOC 0211). I have been with the same company since 2000, holding different position starting as engineer. Do you think CIC Buffalo will accept this copy H1B petition letter (it includes experience, education, and job description) as my experience letter?

yes, employer will never issue experience certy which is not mentioned in petitioner when they submit your application to USCIS. remember Buffallo embassy will never ask about your details to USCIS, thats why we are not going to submit I797. if your employer want to issue different Exp_letter he/she can issue, but employer dont know the process of Canadian PR so they worried and think that its against law. yes its against law but we are not using which is depend on USCIS, so no problem at all if your employer issue another exp_letter and you will submit it when you get AOR and request for full docs..

The problem is my employer will not issue a new experience letter and I am planning to use the copy of H1B Petitition as my proof/Documents to CIO and that is all I have to proof my Project Manager and other experience. Do you know that if you apply AINP H1-B, you asked to submit the H1B Petition letter?
