My fiance is arriving from england soon and were excited about being together again but nervous of what may happen at customs when he arrives. On his previous visit he overstayed the six month visa by one month. In all honestly we didn't think about it; ignorance is definitely not always bliss! We were returning from a holiday to the states when customs made us aware of our error. My fiance was given the choice to return immediately to england or the detainment center. He opted for the center where he went before a judge who left us with the impression that perhaps customs overreacted and the judge stated he could be released and return on his scheduled return flight home. The judge also stated that as he was leaving voluntarily there would be no issue in returning back to canada. There is no paperwork from immigration canada insisting on my fiance leaving the country. This happened almost a year ago and now my fiance is returning! We are so excited about being reunited (I did travel to england for two months to be together) , but we are worried that is will be a discretionary call by an immigration officer and we don't know what to expect. It would be horrible to come this far and then face more difficulties. We want to be honest my fiance wants to state that he is coming to be with me and we plan on marrying and applying outland. We don't know if honesty will work against us though...we are hopeful that there will be no issues at all at immigration; but what if there are? Does anyone have any suggestions of what the possible outcomes could be and what we should do if things go awry?
Any thoughts, knowledge and experience would be greatly appreciated.
