Fiancé Visa To Uk - Complications

I'm looking to move to the England from Canada under a Fiance Visa, but my Fiance who is a British Citizen is unable to work for a year or so and it says the sponsor needs to be earning 18600 a year. This is impossible for her as she needs physiotherapy sessions a few times a week which would get in the way of working, and she needs to apply for Disability Living Allowance which doesn't provide that amount of money. And even when she is able to work, it wont be full time or in a high powered job. Would her condition be an acceptance? Could the household income of where we'd be living help to prove that we'd be capable of supporting ourselves within it?

I would look for work ASAP, and we wouldn't be living in our own place together until she's capable of working, so we'd only need to contribute towards rent and bills, not pay full ones. It says that exemptions are made for people getting disability benefits, but I'm still anxious that she might not fall under that for whatever reason.

Please help,

Thank you

Hi there. This is a forum for people going to Canada. Maybe something like this might be more useful: http://www.alloexpat.com/moving_to_england_forum/england-immigrant-england-immigration-visa-to-england-f4.html

Good luck!

Personally, I think it would be almost impossible to obtain a UK entry clearance under these circumstances.
When I brought my wife to the UK from Canada, I had to prove that I could support us both with no reliance on welfare. Her income or lack of it was not relevant. The only way that you could proceed would be a formal commitment from a third party to support you both. Note the clause (v) about living accommodation being exclusive.

Code:
 290. The requirements to be met by a person seeking leave to enter the United Kingdom as a fiance(e) or proposed civil partner are that:

(i) the applicant is seeking leave to enter the United Kingdom for marriage or civil partnership to a person present and settled in the United Kingdom or who is on the same occasion being admitted for settlement; and

(ii) the parties to the proposed marriage or civil partnership have met; and

(iii) each of the parties intends to live permanently with the other as his or her spouse or civil partner after the marriage or civil partnership ; and

(iv) adequate maintenance and accommodation without recourse to public funds will be available for the applicant until the date of the marriage or civil partnership; and

(v) there will, after the marriage or civil partnership, be adequate accommodation for the parties and any dependants without recourse to public funds in accommodation which they own or occupy exclusively; and

(vi) the parties will be able after the marriage or civil partnership to maintain themselves and any dependants adequately without recourse to public funds;

That Forum is a disaster area. No use to anyone I suspect. It looks completely unmoderated judging by the amount of SPAM posts. Abandoned?

Agreed. I have updated my post with the appropriate legislation quote. The UK is getting very strict these days.

Chaos Seeker, perhaps try the forums at BritishExpats. com! They may have a resettlement section.
