"Some of the people targeted are believed to have used crooked consultants who submitted fraudulent applications on behalf of people who didn't meet the qualifications for citizenship — such as residency requirements. "The bottom line is three years residency in Canada but a lot of people misrepresent the amount of time they spend here . . . (They) are actually living and working in Dubai, for example, but claiming they are in Canada and may be using consultants to manufacture evidence that they are here,"

"It is difficult for the government to track such cases because Canada doesn't have exit controls, residents can move easily across borders and it is difficult to track how long some have been gone"

I am not shedding any tears for them. It seems to me that many immigrants think more about what they can get away with than honouring their contract with immigration. There is no use saying "the consultant made me do it" when they get caught.

I am glad they are doing this, I think they should be deported too, if they can fake citizenship application who knows what else they faked. Unfortunately conservative government is very liberal

If they really got the evidence for those who used forged documents for obtaining Canadian Citizenship, fed has the opportunity to set these people as an example to the world that Canada does care its laws even for people who initially succeeded.

Otherwise, a different message would go if those people keep living in Canada that "Canada doesn't care its own laws for immigration and citizenship, if anybody gets it on forged documents, they can still live here based on their ties with this country".

I heard people are saying it would be very difficult for the Govt to revoke their citizenship as they have sufficient ties here, e.g. kids born in Canada. Is this true?

thanks.

Only based on sufficent ties dosent count. Lets say i enter Canada with fake papers, get married to a Canadian and have 10 kids, buy a house, car and the whole nine yards. Finally I get caught are my ties enough to allow me to stay here?

newtone,

Since you are married to Canadian, you qualify to become immigrant legally.
So, in this situation, it will be difficult to revoke citizenship, however, if they still do, you can apply based on spousal immigration.

thanks.

Now it starts becoming messy...

Someone gets granted citizenship by using false documentation. He files for wife and 3 years later while living in Canada the wife becomes a Citizen. They have children born in Canada.

Now you discover the original fraudulent application and decide to revoke the original applicant's citizenship. Would that affect the wife's? Since in the first place he shouldn't have been able to file for the wife. Should the wife be punished for a crime committed by somebody else? If it does not affect the wife, can she just turn around and immediately file for the husband?

What about the Children that were born in Canada? I am sure those will have no problems.

Welcome to the world of Immigration.

I am sure it is on a case by case basis and I am sure that children born in Canada would not have their citizenship removed, even if their parents were illegal.

As for the original PR who lied and became a citizen and sponsored his wife. Maybe his wife should not be punished for his crime but should she benefit from it? If they get deported, is the wife somehow worse off than she was before she got sponsored?

If a man robs a bank and with the money he builds a house, marries a wife, has children and he can afford to offer them the best life has to offer. If the man is later caught, should the wife keep the house and the bank account? Is she being punished for his crime if she loses her share of what he had gained illegally?

Anyway, there are many options to appeal in the system and I'm afraid that the 1800 removals will tie up the system for years and cost all kinds of money but it's either that or let people get away with it. Maybe they should start enforcing exit controls. If they did, they would know who enters and who leaves and when.

Although it is difficult to trace people when exiting/entering Canada, it is not impossible though.

Govt. can easily find out who leaves/enters Canada by quering the carriers database as all airlines do save their flights data into the database.
They can query using passport number, passport expiry, name, date of birth and so on.
Good news is that all this information is readily available.

If a person exited from USA, Canadian Govt can request this information from their American counterparts.

Do you know what those illegal citizens enjoy? Their families stay here in Canada claiming all Govt generous benefits including child benefits, health benefits, low income support benefits and so on... and still don't pay any taxes as they don't show/report their foriegn income. Their families enjoy driving big SUVs which an average Canadian can only dream of.

What if you earn a foriegn income especially in Arab countries on Canadian citizenship, you can earn from $100k to $200k/year and keep all this amount since you report low income to CRA? Govt will give you all possible benefits that could range from $2000 to $3000 per month depending upon your kids in Canada. This becomes another $24k to $36k/year after taxes. So technically you're making a lot of money from both ends (foriegn income and Canadian Govt) and enjoy all first world benefits.

See how these people abusing our system?

However, they have already been disqualified from Canadian Citizenship as Citizenship Oath reads:
I swear (or affirm) that I will be faithful
and bear true allegiance to Her Majesty
Queen Elizabeth the Second, Queen of Canada,
Her Heirs and Successors, and that I will faithfully
observe the laws of Canada
and fulfil my duties as a Canadian citizen.

As they are not truthful either in getting immigration or citizenship, Govt can easily revoke it from them.

Hope this matter will be dealt with strictness and no favor be given to any individual, Period.

thanks.

Re: Feds plan to revoke fraudulent citizenship of 1,800 -ATTN: Leon and Alabaman

What will happen to the 1800 people if they have their citizenships withdrawn? Will they revert to their status before they gained citizenship or will they be asked to leave Canada? What EXACTLY does the law say?
If they lose their citizenship and leave Canada , can they reapply afresh as immigrants if they qualify under any of the criteria?
Do they have any mandatory period of waiting before reapplying for immigration to Canada because of their previous citizenship being withdrawn?

I don't think this information has been published.

Hopefully they will lose both citizenship and PR status - and will also be given a two year ban from entering Canada for misrepresentation.

This is how a Canadian citizenship can be revoked and the consequences:

http://www.justice.gc.ca/eng/news-nouv/nr-cp/2007/doc_32019.html

So, it all depends on concrete circumstances of each of the 1800 cases... In any case, it won't be as simple and easy as it may sound... Politicians sometimes present things in a more favorable way than they really are.

Here's an example: http://www.lawyersweekly.ca/index.php?section=article&articleid=1521
