Hi Guys,
Just wanted to know if anybody could be eligible for FSW category under Express Entry without LMIA ? My profile shows that I'm eligible under both CEC and FSW which has put me in doubt.I want to get invited under CEC as I have all the documents to support just CEC (I'm assuming that LMIA letter is a requirement for FSW category and would not be able to provide it if I get invited under FSW Category )

I have been working on PGWP for almost two years,NOC type B job after graduating from a two year program in Canada.
I mentioned in my profile that I have an open work permit and no positive LMIA was provided for this position or the work permit. I don't know how my profile is showing me eligible under FSW without an LMIA. I have 460 points btw.

Help is appreciated.

Good luck !

LMIA is not a requirement for FSW The requirements for FSW and CEC are practically the same, only difference is FSW needs work to be continuous, ECA is necessary and the proof of funds. So most people eligible for CEC are also eligible for FSW. Also, if you're eligible for both, the system invites you under FSW.

Thank you purplesnow. I was hoping to avoid FSW and get invited under CEC, it just sounds bit more complicated.

I'm assuming I would not need to produce ECA for Canadian Education ? Also for funds, is there a minimum average I need to maintain in my account over the period of few months ?

Thanks!!

no you'll only need the ECA for your foreign education. The proof of funds needs to be in your account when you submit it, there's no requirement that you have to have it for any period of time leading up to that point.

oh - unless you said yes to having a job offer? If you did, you might need to decline the invite, change that to no and wait for another ITA.

I just rechecked and yes I said yes to Job Offer. I think that pertains to having an LMIA and not the job on PGWP without any LMIA .So I changed it back to No, hopefully after the update is processed I would be ineligible for FSW.

ah. you can't make material changes like that post ITA though. And it won't just re-issue you with a CEC invite. You'll have to decline and wait for the next draw... sorry

Sorry purplesnow , I forgot to mention that I haven't received an ITA yet . I just made my profile a month ago , little late since there has already been a draw with 453 points . I am optimistic though , we should see cut-off going below 460 at some point.
