Hi,

I applied for my husband's spousal immigration - Outland as we plan to be together once he gets his residency. The only issue is that while his file is in process, he has been informed by his company in the USA that there are likely to be layoffs. We applied based on his residency in the USA as he is on work permit (H1). Does anyone have any idea if this will affect his file since we got all his documents from the US where he has been residing for more than 5 years?

We are wondering what the implication could be regarding his file and whether he will have to appear for an interview in his home country of if Canada would be the location in case this happens and he has to come to Canada and stay with me on "visitor status" while he awaits some news. Would he have any issues at the border if he has to leave knowing that his entry into Canada would be while his PR application is in process? Also, does anyone know how long he can stay in Canada if he has to come as a visitor. Can we extend beyond six months if needed given that he has a valid visitor visa for Canada until 2017?

Looking for some advise esp. if anyone has had such experiences.

Only one thing I can help you with:

He can visit Canada with his visitor visa when PR is in process (many of us did the same). The officer at the point of entry determines how long he can stay, but usually they give full 6 months. After that (before full 6 months expires) he can apply for an extension of stay. Most of us waiting for PR are granted the extension, usually up to a year. I myself asked for 10 months and was granted that full length.

Make sure when he comes as a visitor to say that he is visiting you (some say they are moving, which is a huge mistake). It is STRONGLY recommended to have a return ticket. The only issue is that he has to show that he will leave country after his visitor status expires, so if he loses his job he will have to show some other ties to USA or his home country.
