Hi everyone! I am new here and I have several questions for people who may know about sponsoring a family. I have an aunt who is a Canadian citizen already and she has sponsored me as her niece. She already submitted the application just last month, but as I have read through the CIC site, something bothered me. It states:

Who can be sponsored

You can sponsor:

1. parents
2. grandparents
3. brothers or sisters, nephews or nieces, granddaughters or grandsons who are orphaned, [glow=red,2,300]under 18 years of age[/glow] and not married or in a common- law relationship
4. another relative of any age or relationship but only under specific conditions (see Note below)
accompanying relatives of the above (for example, spouse, partner and dependent children).

Note: you can sponsor one relative regardless of age or relationship only if you do not have a living spouse or common-law partner, conjugal partner, a son or daughter, parent, grandparent, sibling, uncle, aunt, nephew or niece who could be sponsored as a member of the family class, and you do not have any relative who is a Canadian citizen or a permanent resident or registered as an Indian under the Indian Act.

Since I am no longer under 18, I cannot be sponsored as a niece then. So I may fall in as another relative of any age or relationship. But as emphasized, there should not have any other relative who is a Canadian citizen too...I have first cousins who grew up there.

Anyone by this case? Would I really qualify as a candidate? and if not, can I withdraw my application so I can apply to other categories? Can we submit two applications at a time since I'm planning to apply as a skilled worker.

THANKS!

Are your cousins your aunt's children, or her nieces and nephews? In any case, if they are Canadian citizens, she can't sponsor you, unless she lives in Saskatchewan or Manitobe. In those provinces, an aunt can sponsor a niece under certain conditions, but the application is not filed under family class in Mississauga. The forms are different.

Hi! They are also her nieces and nephews in Canada(my first cousins). She lives in Alberta. So I won't qualify then? Can we withdraw the applicaation even if there has not been any response yet? Can I submit another application now under another category?

THANKS SO MUCH! =)

Basically for it to work, your aunt has to be alone and lonely in Canada to be allowed to sponsor you. She can not have living parents, husband or children who either could be sponsored or are already citizens or PR's.

If you have realized you are not eligible, you might as well withdraw and see if you can get your fees back.

Are you sure your aunt sponsored you under the Family Class? Alberta did have a family stream under their PNP program and she may have applied through that before it closed. Check to be sure.

My story right now is a little similar to your story. I have an aunt who is already a citizen living in Edmonton Canada and she is really willing to sponsor me as nephew and my sister as niece as what she promised us when we were still kids, when she was with us in our Country way back 15 years. I never forget that. I am currently above 18 years old and good thing that my Aunt dont have any relative living in Canada. This is actually their first to apply for sponsorship together with her Canadian Husband. We already submitted our applications 2days ago and my problem is that we chose the wrong category when answering the forms, particularly the Generic Application form. We chose "Orphaned sibling/nephew/niece/grandchild" and I realized later when I re-read the CIC site, it should be "Other Relative" when the Sponsor, my Aunt wants to sponsor nephew and niece who are above 18 and We are not an orphan as well. I was confused that time and I was so dumb realizing this mistake by not researching for further information as I was so excited. Can this simple mistake affect the processing of the Application? Do they really return your application due to this mistake? My aunt also included an Appeal letter to the application as a support that she really wants us to be sponsored together with my sister and she dont want that to be postponed as she already kept and planned for it for 15 years now. And she will really support us until we started our own career and be stable enough to be on our own in the future. That's what it made me bother now. Anyone out there who experienced as the same case as mine, please provide some positive information. Thank you and God Bless!!!

Your aunt cannot sponsor you. She has a husband. This means she has family in Canada and doesn't qualify as your sponsor.

But my Aunt has no children as they are not gifted with a child. I dont know, Im totally confused but we already submitted our applications, it is up to them what is their final decision. We'll try but we're still hoping for positive result. But what bothers me most is that the category I chose in the Generic App is wrong.

It doesn't matter if she has no children.

In order to qualify to sponsor you, your aunt cannot have a husband, cannot have children, both her parents must be deceased, and she cannot have any relatives in Canada.

There's no chance of a positive result since she has a husband and doesn't meet the basic requirements to sponsor you. The application is guaranteed to be refused. Unfortunately there is zero chance of approval.

Hi JohnPat,
is there a response from your application or do they sent you AOR from the date of your submission? I am in the same situation as you. However, I am in the stage of consolidating my documents and plans to submit it by November of this year.
Thanks in advance.

If JohnPat applied, he would have been refused since his aunt doesn't qualify to sponsor him because she is married. Zero chance of approval in his case.

Hi Scylla,
if zero chance to qualify, can I create an Expression of Interest for Manitoba while waiting for the immigration officer to issue the decision for Sponsor Approval?
