Hi,

I am hoping to get some advice from those people 'in the know'.

I sent in my application in May of this year with my IEC visa expiring in mid June. My application had a open work permit included in the application. I have since lived in Canada for the last 2 months under the assumption that I can continue to stay here as a visitor but not work, as per other threads in this forum.

Bad news today when the application was sent back to my partner. The attached letter refers to a incomplete document, IMM 5285 Spose/Common Law Questionnaire. I had instead filled out IMM 5490, which upon googling the difference I discovered was for outland applications. *Sigh*! Most of the documents have stamps on them showing receipt of forms as May 26th 2014.

The letter says:
"Your entire application package, along with all requested documents.information, and a copy of this letter must be resubmitted in order to be processed."

I am going to seek advice from a lawyer this week but in the meantime to appease my panic, I was hoping for some clarification from the experts who visit this forum.

My questions are:
Am I still able to stay in Canada as a visitor?
When I resubmit this application do I need to pay again?
How long will this delay my application? Presumably it will be treated as a new one?

Sometimes when people get apps returned, there is a part of the letter from CIC that specifically mentions if you re-submit everything within so many days, you will maintain your "implied" status. Was there any indication of that?

Im sorry I missed this reply.

Unfortunately, although it stated to include the letter with the full application again to proceed, it made no reference to implied status.


This problem has resolved itself as I am about to leave Canada and apply from London.
