Fairness letter

Hi,

Need help. Please suggest.

My employer has not verified my leave approval letter upon verification from Canadian embassy. Now I have received a fairness letter to which I have 30 days to reply. What should I do and what if I do not reply to this fairness letter.
P.S. They have sent my passport back with this letter.

I will really appreciate any suggestions/ advise.

Hi,

A 'Procedural Fairness Letter' allows an applicant to provide additional information before the visa officer makes a final decision.

For TRVs, such letters are normally issued for suspected misrepresentation. If found true, the applicant could be made inadmissible/receive a 5-years ban on entering Canada.

You'll have to provide more information on your situation + what did you apply for?


A word of caution:
Your chances of proving that you/your employer did NOT commit any misrepresentation for your visa application..... are almost slim to none. You can try though

Hi,

You may only get a TRV refusal..... or in a worst case, you may get a 5-year ban from entering Canada (which could make it quite difficult for you to visit/immigrate to Canada.... even after the 5-year ban expires).

You cannot submit all your employment documents again. The visa office probably believes you have made a misrepresentation.

Did you submit any fraudulent documents?
Did you forge your employer's signature?
Did you give false information in any document or evidence? Not just for your employment, but for your personal/financial situation.
Have you been refused visas for any other country (particularly the US) but you did not disclose this fact in your TRV form?


Ideally, even if you had made a mistake in your TRV application unintentionally, you should have informed the visa office BEFORE this was scrutinized/you received the Fairness Letter
