Factual Resident returning to Canada

Hello everyone,

My fam and I have lived outside of Canada in Honduras for 2 years as Factual Residents. I have filed my taxes while outside of Canada and before these 2 years abroad I had a good paying job in Canada.

My question is: Could I apply for EI once we return to Canada this summer? So I would I apply for it, once I arrive in the country, not outside.

Filing taxes doesn’t make you eligible for EI. EI is for those who lost their jobs or were laid off through no fault of their own. Have you been working for a Canadian company or the Canadian government while in Honduras. If not, you are not eligible.

Assume you contacted CRA for them to determine your tax residency status and inform CRA that you were a non-resident.

No you don’t qualify

EI is based upon insurable earning in the last 52 week window PLUS you had to have paid EI

EI will look at your ROE from your job from two years ago and you’ll automatically be disqualified
