Hi.
My boyfriend and I sent in our inland spousal sponsorship in early February 2013. Along with that I extended my stay. I received a visitor record today in the mail which is valid from April 2nd until August 9th - which is that normal? I am confused about the whole thing. We also applied for an open work permit which is attached along with the inland application. So once that hopefully gets approved (is that after AOR or 1st stage approval?) then I get an open work permit sent to me by mail and then I am pretty much good to work?

Sorry if these questions seem simple to some, but I just want to be sure we are doing the right thing!

When you applied inland with the OWP included, did you send it in before your previous status expired?

If you did, then you didn't actually need to apply to extend your stay, as the OWP app gives you implied status once your other status expires.

From CIC:
"In situations where an applicant who has visitor status submits an application for permanent residence to Vegreville and at the same time submits an application for a work permit (pursuant to R207(b)), the visitor may be considered to have requested an extension of their TR status (in
accordance with R183(5)). They are considered to have implied status as a visitor, until a decision is made on their WP application.
When no application for a work or study permit is received with the application for permanent residence, the applicant is obliged to apply to extend their visitor status."


I believe that the implied status takes precedence over the visitor record but you may want contact CIC to be sure.

Thanks for your reply!

I applied for an extension just as my International Experience Canada visa ran out (2 days before) so I did just to be on the safe side. We did include an OWP along with the initial application. So this visitor record runs out in August 9th I'm hoping to get the OWP before that - but what if it doesn't?

Did you send the OWP and PR app before your IEC visa expired? What I'm trying to say is that if you did, you didn't need to apply for the extension at all because the OWP app would have given you implied status after your IEC visa expired.

So what I'm concerned about now is that this extension runs out in August and we are hoping that we get 1st stage approval (is that AOR or when the application is being filed to another place?) before tht visitor record runs out. found it hard to understand it all to be honest..

Sorry if it all sounds silly.. I appreciate your help :)

Seems to me they gave you four months since that's the amount of time it should take to finish stage one given they've already had your application for two months already!

How many months did you request for the extension as it seems you only got 4 months? I had requested one year and got two so it depends and my application was outland so I guess it depends sometimes on what you requested and of course it's always left up to their discretion. Once work permit is received after AOR approval in principle then you're good to work.

Is that right? I don't recall requesting anything lol.. I'm not too sure. I have stayed in canada on and off very frequently and once got a warning for visiting too much, so maybe that has something to do with it? I'm assuming we are golden though since its roughly around the time I get 1st stage approval.

Now I just want to make sure here.. So AOR and 1st stage approval are two different things, right?
So in about 4 months time (considering I have already gone through 2 months) I get an OWP? I'm desperate to start working again haha.

You still didn't need to apply for the extension. Because the OWP and PR app was postmarked at least a day before the IEC expiry, you would have been on implied status as soon as the IEC expired even though it was only 2 days after mailing the app.

AOR = Acknowledgment of Receipt (that's only CIC telling you they that have received your app)
1st Stage Approval = partner approved to sponsor, OWP granted

As I said before, I believe that the implied status from the OWP overrides the visitor record but you should contact CIC to confirm this.

Hey guys, my situation is a little bit different but somewhat similar to yours..

My husband is gonna apply for his study permit, and along, apply for my owp.. i am currently in canada as a visitor, with my status to expire in sept.. after applying for the owp, should I apply for an extension of my status (just in case the processing time takes longer than my status)? Or the owp application by itself gives me the implied status right away?
