Extending Visa Probs. While Waiting for PR

Hi All ---

My sponsored wife and I (CDN citizen) have an approved PR in progress - currently being processed in Paris.

We moved to Vancouver in Nov. 09 and tried extending her temp visitors visa in April - within 30 days of the six-month deadline. The CIC online payments were unavailable as the payment facility was down for weeks. It was also not possible to have bank payment slips sent.

A post was made on their webiste, to send paper visa app. forms explaining current circumstances, in each case the visa status/situations will be considered - and not to re-send applications or payments.

We sent all info - visa App, PR submission/pmnt info, passport copy and a letter explaining ability to pay immediately but w/o access to CIC. We sent all paperwork to Vegreville five weeks ago - and now the six-month visitor period has lapsed.

Should we just hold tight?

Any help or info would be greatly appreciated --

I would hold tight if you sent all the info and you got confirmation that it was recieved.Then there is not much else you can do right.You did exactly as they asked.They know your out of status but im pretty sure once you sent it in she has implied status until you get your answer back.They will most likely approve her and she is under implied now so i think your fine.
So i would just relax knowing you did your part.

Thanks for the quick reply --- although we havent heard anything back from Vegreville - like you say, we've done our best! we'll go with the 'implied status' and hope the PR shows up sharpish.

5.27. Legal temporary resident status in Canada
Under the current Regulations, applicants in this spouse or common-law partner in Canada class
must have a valid temporary resident status on the date of application and on the date they
receive permanent resident status to be eligible to be members of the class.
However, under the spousal policy, applicants who lack status as defined under the public policy
(see “What is lack of status under the public policy” below) may be granted permanent residence
so long as they meet all the other requirements of the class (i.e., they are not inadmissible for
reasons other than “lack of status.”)
However, applicants who do not have temporary resident status and who cannot be granted
positive consideration under the public policy can be removed at any time. Further, the spousal
policy does not change the requirement to seek necessary authorization to visit Canada or to
work or study here.
What is “lack of status” under the public policy?
For the purposes of the current public policy, persons with a “lack of status” refers to those in the
following situations:
• persons who have overstayed a visa, visitor record, work permit, student permit or temporary
resident permit;
• persons who have worked or studied without being authorized to do so as prescribed by the
Act;
• persons who have entered Canada without a visa or other document required by the
Regulations;
• persons who have entered Canada without a valid passport or travel document (provided
valid documents are acquired by the time CIC seeks to grant permanent residence).
