Hello.
Here is a little backround on my situation. I am Canadian, my Husband is American. We crossed the border in March, he was granted 1 month to stay in Canada. We immediatley applied for an extension and were granted 3 months. We got married may, 18, 2014. We applied for an extension back in June and asked for 6 months, He was approved. Now his visitor pass is expiring December 5th. We are in the process of applying for a new extension ( I hope they can approve him ) We have sent in our Outland Sponsorship Application, so i'm hoping that can help.
As of right now the processing times for online applications for extending his stay are at 22 days, Which will make it over his expiry. I have heard of implied status and I'm just a little confused. It states on the website that he would be implied status by law until a decision is made. Now my question is if he ends up being denied and has to leave, how does he prove to the border when he hands in his visitor pass, that he was implied status? Just show the receipts for the extension? I just want to make sure that if the worst case senario was denial that we do it right so when he comes back he wont be on bad terms. As of now we are in pretty good standing.
