Extending my work permit without being asked to leave

My two year iec permit is up in December and I did a survey on the government website that said I may be eligible to apply for an extension. I saw two lawyers who said I wouldn't be able to apply for permanent residency but an extension would be good enough for me for now. The only thing is..if they deny my application will I receive an order to leave the country? Because, If I can't get a work permit I want to stay here as a tourist still and have the funds to support myself indefinitely.

More background information...I own a business here but only 45%. I know I could not work in said business if I do not have a permit but the agreement I have in place is that I can still receive a lesser profit by not working. Apparently if I own 50% or more then this could help? Would it be accepted if just get the documents changed to me owning 50%?

I do not have any experience under CEC skilled worker to apply via that route and the role I have in the business is not one that would be easy to prove no canadian can do.

Thanks in advance!

IEC visas cannot be extended. If you want to work past the validity of your IEC, you will need to apply for a closed work permit. To qualify for a closed work permit, your current employer or a new employer you find will have to obtain an approved LMIA. The LMIA gives your employer permission to hire a foreign worker. Before the LMIA application can be submitted, your employer will first have to advertise the job for a minimum of a month to prove no Canadian could be found for the role. The employer will then have to pay a processing fee of $1K and submit the application for approval. Processing times are anywhere from 6 to 16+ weeks.

Unfortunately owning your own business will be of no assistance in obtaining a work permit. There are no self-employed or entrepreneur work permits available. The LMIA route is your only option unfortunately.

Good luck.

No - IECs don't qualify for implied status. Unless you have a new and approved work permit in hand, you must stop working as soon as the IEC expires.

For all other work permits, you must have the new work permit application submitted before the work permit expiry to get implied status. Just submitted the LMIA doesn't give you implied status at all.

But again, none of this is relevant to IECs since they don't benefit from implied status. Any work past the expiry date is illegal.
