Hi,

I am currently an international student in Canada and my husband accompanied me on an open work permit. My study permit is to expire in August 2014, I will apply for an extension based on the fact that I will be unable to complete the course i am attending by August next year.

My questions are that:
1. Can my spouse also apply to extend his open work permit based on my extension of study permit? Would this be acceptable to CIC?
2. Should he apply for his extension along with my application? or should he wait for my study permit to be extended first?

Thanks.

Yes, He can.Yes.

You can go either way. But I think doing it together is better.

Hi,
I have a dilemma about extension of spouse open work permit. The rules are not very clearly stated on CIC website and creates confusion.
I already have open work permit and has started working here in canada.

My situation is:
My husband's study permit expiry: 30 Nov 2014
My passport expiry: 27 Oct 2014
My work permit expiry: 27 Sep 2014
I will be applying for passport renewal here and will get by May 2014.
My husband will apply for an off-campus work permit in June2014 through which he will get off-campus WP till Dec 2014. He will apply for an actual Work permit once he receives his transcripts in Oct 2014 approximately.

Question is:
2) How and when do I apply for extension so that it comes before my WP expiry? Do i apply for one extension after I get new passport which hopefully get me a WP till Nov 2014. and Then apply with my husband in Oct 2014 for another extension?

I am really confused and cannot find any answers online. I would like to know if you can help me. Do let me know.
Also, can I apply for PR during this time? Is it valid?

You should extend your current workpermit as soon as you have your new passport. I guess you need to provide copies of your husbands study permit to show proof.

As you are a souse to a student you can't extend your permit beyond the student permit as that takes precedence. Logic would tell you that.

As for your husband's PGWP, that may or may not happen. There are zero guarantees that any of us receives PGWP after graduation.

Once your husband receives PGWP, he will be a temporary worker.
For spouses of temporary workers the following is applied:
http://www.cic.gc.ca/english/helpcentre/answer.asp?q=199&t=17

Briefly, you can apply for new OWP , if your husband will have a job satisfying requirements in the link.
