Hi All,

I have a question regarding Blood Relative residing in Canada who is either a PR holder or a Citizen. My wife's brother is a PR holder but I am the primary applicant. Can I still claim points under the relative option..??

Thanks,
Sanjay

Yes i guess you can as per below:

Do you or your spouse or common law partner (if they will come with you to Canada) have at least one brother or sister living in Canada who is a citizen or permanent resident?

Note: to answer yes, the brother or sister must be:

  • 18 years old or older
  • related to you or your partner by blood, marriage, common-law partnership or adoption
  • have a parent in common with you or your partner
A brother or sister is related to you by:

  • blood (biological)
  • adoption
  • marriage (step-brother or step-sister)

You can for sure claim the points for your spouse's brother being a PR, even if they are not accompanying you.
For documentation, they should be able to provide their PR card and some household invoice for electricity/telephone/gas/water etc. to prove that they are a PR and present resident of Canada.

While checking for "Eligibility" using the Eligibility tool to generate the code, i found that the question about a relative is asked only for the primary applicant and not while adding spouse details. As mentioned earlier, my wife's brother is a PR holder. Since I'm the primary applicant, can I go ahead and choose yes for relative option..?
