Hi there,

i've got a situation coming up soon and would like to hear your opinion(s) about. i heard/found many contradicting articles in the www.

Situation:

(Entered Canada (Toronto), resident in Montreal: 3rd August 2011 )

Visa 2011: "Young Professionals 2011 Program" 1 Employer only, valid from 3rd August 2011 'til 31st July 2012

FYI (Visa 2010: "Working Holiday" 19th July 2010 - 18th July 2011 Open employer)

Applied for Perm. Residency November 2010 QSW, received CSQ, applied for Federal, October 2011 Buffalo/NY, waiting for AOR....

Intentions:

Extension of the Work Permit with Reason to Finish Perm. Residency, which should be done hopefully by the end of the year. Having the same employer since August 2010, Employer wants to keep me as long as possible, so, employment isn't the problem.
I read on CIC.ca if you apply for extension, do it up to 3 months before expiration. (beginning of may latest to be sent in my case)


I would like to stay here of course until its done, but i hope i do not have to go through the LMO-hassle, because my employer is not exactly the most organized one and paperwork is a mess with him.

Can somebody advise please?

There's no way you can get around the LMO requirement. If you want to keep working for your currently employer, he's going to have to file an LMO. If he's not willing / not able to go through the LMO process, then you'll need to find a new employer who is if you want to stay past the expiry of your young professionals visa.

thank you for the quick reply.

So, i do need, even for the extension, the CAQ ? (or a photocopy of my current CSQ is fine as well?!)

And, even if i didn't need the CAQ in the first place (Young Professionals VISA for Canada), i still need to apply for one to extend my current Work Permit?

I thought a Job offer letter from my company on company letterhead, stating the start/end date, salary ect.. would be enough... because i'm already here,... and didn't need the CAQ in the first place...mhh....thats going to be a pain then...only for an extension...pffff...i hope Buffalo is going to pull their finger this year....

The Immigration paperwork doesn't make much sense to me here....

Hello there i am a german Cityzen and have my young professionals work permit which
is a close one to the company that i worked with when i was in Canada, the thing is that its
still valid until 23 august 2014 but i left canada on november 2013 to visit my family and
do some courses. can i still go back to canada and would my work permit be still valid..
and one more question: once the crrent one is expired would i be able to extend with it
the LMO form or so??

Would be grate fll for all your replies

I'm a bit confused about what you said. "..is a close one to the company that i worked with when i was in Canada...".

1. If you are still at the SAME company with the SAME Work Permit expiring August 2014, then YES you can go back. BUT
check your Work Permit for notes such as "No Multiple Entry Visa" or "No Re-Entry allowed". I do not know which Province you are.
Usually, Germany is excluded from that. Speaking from experience for Quebec. Re-Entry allowed.

2. If your current one expires, if you are in Quebec!!! then all you need is a Job Offer with Start/End date, Salary etc, 150$ and your possible
CAQ if you applied for PR, like i did. That is what I did.

3. If no CAQ is available, LMO is required! Plan about 4-6 months for that, depending WHERE you are. (Quebec 3-4months, Ontario seems to
be 5-6months minimum) THEN you need to apply for a Work Permit...Online 2-3 weeks....Paperwork 2-3months...

is thus a close one. but it says on the bottom ''this does not authorize rentry''
but since im a german citizen i dont need any visa or so to enter canada.
in case i can go back would it be possible to continiue the current one to a new
one of the same kind.. naming the same company etc... ?? thanks for replies my
friends =)

hi whats up,

i have never been in quebec i was in ontario and the visa is for ontario.
i have used my working holday one already 2012 -2013! hey another
thing if i go to college full time programm, am i supposed to be exempt
from international fee and can pay out the domestic amount. it says so
on carlton university ,, so could i have a student visa during the close
working permit?? thank you my friend, seems like your german u got the
german flag on your profile pic.. u live in canada now. i have seen many german
people there.. take care.

You can't hold a study permit and close work permit at the same time. You have to pick one.

You would pay international student fees. Domestic student fees are only for those who are already PRs or citizens of Canada.

well im not the right guy wiht lots of knowledges, but on seneca collge website they
say theres such regulation which says:

•Foreign worker and spouse or dependent family members: a foreign worker is a foreign national who is authorized to work in Canada having been issued a work permit. For purposes of this category, a foreign worker is to present a valid work permit which names a Canadian employer situated in Ontario and the prospective occupation, and is valid for at least six months. The family member must present the foreign worker’s work permit. If a student has a work permit without naming a specific Canadian employer situated in Ontario, the student and his/her family members are not exempted from international student fees.

or check that out correct if im misstakin someething

immigration laws are complex and change many times.

But as much as i know, i can only agree with Scylla, you have to pick one. Since, if you have a Student Permit, you're supposed to work only a certain amount of hours during this particular period. A Work Permit (normally!) allows you to work full time. Its complex, but simple again. either one it has to be. Do not rely on the College Website. This one you have to sort out with immigration first. what ever is says there what you can have and/or get, then you check with your college.

btw, yes i'm a german, having successfully acquired my PR since 2012. :) What a pain...

well yeah i know iam attending University now in Germany Lüneburg, i might stay and come next year then or year after.

congrats for yor PR approvement =) what catogry did apply under and what did you have to Show. I think i m gonna try canadien experience class,
i had been in Canada for 1 and half yaers but i dont have all my checks listing tax deductions is this bad?

i applied under QSW with my WHV...and after that a Young Professional Permit...this expired also in July 2012...but i got PR in November 2012...so i had to apply for a WP extension for 1 year...not knowing i would get PR 3 months later...lucky....so i could leave my job ASAFP.
