Expiring H1B - can extension approval be forwarded to AB?

Hello.
I am relatively new on the forum, so I apologize, if this question came up somewhere, I coundn't find the answer. I am on my 2nd H1B, which expires at the end of Sep. 2010. However my U.S. employer began U.S. LPR process on my behalf some time ago and by that time I will be eligible for extension beyond 6 years - and I was assured that it will be obtained. However after reviewing current requirements and finding out that I am fully eligible, I decided to pursue Provincial Nomination (through AB) process, and then Canada PR through CIC.
Facing current processing times, I am not sure, if I will receive my nomination within the remainder of my current H1B validity (probably not). However if I will be in the possession of my new approved I-797, will it be possible to submit it to them without jeopardizing my application? Did you guys have such a situation and what would you advise? I am aware that the decision can be made some time close to my current H1B expiration date. My application for extension probably will be filed shortly before current H1B expires so I may not be in possession of appoved I-797 right away at Oct 1st, 2010. Will be greatly appreciated if some of you will share some of your experiences with me.

pedro1,

While your AINP is being processed if the officer finds out your H1B is expired he will ask you for new documents. you can also send the new 797 copy to AINP if you have your file number. this should not be a problem at all. there are many other folks who have their H1B expiring or due for renewal before they get the nomination.

Thank you AG. I am about to send my application in a few days. Meanwhile I am getting familiar with the forum, because there will be probably more questions I will have while application will be processing.

Best regards.
