Hi there, so I am really hoping for someone with experience on this. I know you are allowed to visit up to 6 months (Pending your circumstances correct!?)

I've been visitng Canada for over the past year on trips of 1 to 2 weeeks etc.. Always told the truth to the Customs officer & I will always want too as I do not want to put anything in jepordy whatsoever.

To the people that have gone down the Conjugal sponsorship program & anyone else who can help please, what is and how is the best way to put it across when entering Canada for that amout of time, as I will also want to see if I can get implied status after obviously to rack up the one year! (Marriage will be later down the line incase anyone is wondering)

I know you have to fill out the declaration card on the airplane for amount of days staying to pass to Customs, but I've heard & read they dont like this if you put that amount of days down!?? ....which of course lead me to read stories of just put down a few months then change your plane ticket, etc. I mean do they trully see your circumstances of having a fiance & would this be in my favour?
I also know they have to see ties back to your home country (UK)

I just want to know, do I say I'm visiting for 6 months then I will apply for an extension, afterall this is the way the Government sets this program critera out right.
I just want to do this truthfully & correct without the confusion, your past experience's on this will go along way..thanks in advance.

You do not fit under the conjugal category. That is only for people who cannot be together for exceptional reasons (i.e. gay relationships against the law in your home country, etc). Have you lived together for 1 year? If so, you could apply as common-law. If not, you could visit and then extend your visitor visa when 6 months up to meet 1 year of co-habitation.

Now for entering: I am from UK and automatically got 6 months when I entered. Make sure you have a return flight on you, otherwise they may give you a shorter visit period. Also money. Make sure you have enough, they will fear you might work illegally otherwise. They stamped me through after I told them how much money I had (I had bank statement/traveller cheques on me in case they wanted to see it but they didn't).
Ties: Rent, owning a house, studying, employment, bank accounts.

Another option if you haven't lived together for a year before, you could enter as a visitor and get married and then apply for sponsorship. BUT that could depend on how long you've been in a relationship if it isn't very long and then you suddenly get married it could look suspicious.

Based on your narrative, a conjugal application will fail. Do you in fact mean a common-law application?

Abandon the idea of a conjugal sponsorship! You will not qualify for a conjugal partner sponsorship. There's nothing preventing you from getting married or, living together for 1 year to qualify as a Common-Law partner.

You would simply need to apply for an extension from within Canada, citing that you're trying to establish C-L status. While it's not a guarantee of being approved, it is quite common.

If you ask for 6 months, be prepared to show that you have the funds to support yourself for 6 months and that you have a home to return to after those 6 months. Be prepared to show things like proof of employment (which you probably won't have, unless you have a very generous boss that allows you to take a 6 month leave of absence), home, bank account(s), etc.

A better plan might be to show a return ticket (fully refundable) for a date ~ a month out. If the CBSA officer stamps your passport with a date that you must leave Canada by, you then apply (online) to extend your stay. If s/he doesn't stamp your passport, you get the automatic 6 month stay.

Good luck!

Sorry people, YES.. I mean Commmon Law! My apologogies for the confusion. (See I'm getting confused already)

We haven't lived together at all, just a beautiful long distance relationship over the past year, obviously hard but every part worth it.
I will also have enough funds to support myself.
Each time I've been they have stamped my passport, I've never had them place a date for me to exit though, it's always been very smooth thankfully... So would that mean I've previously been automatically given 6 months then!? This is the main bit I trully want to understand.

Sorry Ponga, can you just clarify the last sentence for me please.
I see if they don't stamp my passport then I get an automatic 6 months. But usually if they do stamp my passport (without an exit date) does that mean I get the automatic 6 months. I've just checked my passport & they all have just the enrty dates. And do you mean a ''month out'' as in just one months trip?

Thank you all for the replys, I just want to get it right, as I would be leaving my job as my company isn't that kind.

William.

The definition of common-law is living together for 12 months, so you are definitely not common-law.

Before you apply for PR you must be married or live together 12 months. No exceptions. As long as you keep extending your status successfully, you can remain in Canada as a visitor for 12 months to get your common-law status, and then apply for PR.
