Error in Application

Folks,

I applied for citizenship in Dec 2013 and since Feb 24, it is in process. So far so good.

But while helping my wife fill out her application last week, I realized that once when traveling outside of Canada and returning, we had gone through the US. When I filled out my application in December last year, I forgot to mention the one night stay in the US each way of our itinerary.

I spoke with the Call Centre today and he advised me to either wait until an officer contacts me as everything seems to be going good so far or advise them of the correction.

Obviously when CIC contacts CBSA, it will show entry from US whereas my application doesn't show that. Application is still in the Sydney office.

Can someone advise the best route to take in this situation?

Hello there,

Well, the bigger issue here is: If you take that ONE day out of your residence calculation in Canada, would you be under 1095 days or above. If you will be under 1095 days, then the judge will have to decide. If you take one day out of the equation and you are still on 1095 days or above, then you are okay and there is nothing to worry about. You just need to disclose that to the officer during your test day (if the officer ask about it).

The eligiblity for citizenship(purely from a number of days perspective) will not change because I was at least 4 months over the minimum days required and the total number of days I was out of Canada will remain same. The beef is I forgot to list that I was in transit in the US heading towards the destination and on my way back. So when they check with CBSA, my application and what they find for that one trip will not match because I didn't list US as my first leg of the trip.

Wondering if anyone has been in a similar situation. Hopefully they don't raise that as a red flag. If push comes to shove, I do have my boarding passes and tickets to show the complete trip though.

Since you are over the days at least 4 months, you should be fine. You will get a chance to explain it at some point and tell them it was an honest mistake.

you are fine. IF CIC asks you, you can explain the honest mistake... CIC do know, people make mistakes... The responses you have provided are best of your knowledge and understanding does not means they are 100% right... You are all good, sleep tight. Good job on keeping a nice buffer, 4 months...

Hello

I passed the citizenship test successful however during the interview I got a surprise that am short of 20 days. Obviously they told me either I have to fill up the residency questionnaire and wait for the judge to decide or I can withdraw the application and start a new one from beginning

I called the call center but they can not advice me if it is better to re-apply or do the questionnaire.

What is your advice ?

While RQ processing has sped up recently, it will still take some time to process and then get an appointment with the judge. Once you do see the judge, there is no guarantee the judge will accept your explanation. It'll probably be faster to just withdraw and start over. But this is just my opinion.

I recommend, you can send letter of explanation and send it to the CIC and you put your file number for reference and explain what happened, because mis-interpretation may lead to reject your application

I will diffidently send an explanation letter to explain the issue, however I want to make sure that re-applying is not going to cause any problem for me. I heard that the other option (Residence questionnaire )is time consuming and not very sure.

Do not worry, one day won't make a diference. It happened to me and the officer corrected it on the interview. No need to send anything. It is a common mistake, sometimes the entry stamps are difficult to read and many people write one day for other. As long as you are not short on the residency requirment, you are good.

I see the overall consensus is to drop it for now and when and if it is asked, I can explain at the time and provide evidence. I am well over my required days of citizenship so that should not be an issue.

I had the same situation as yours but only found out about it during the interview (after the test). The interviewer went thru all the stamps on my passport and then proceeded to the CBSA report against the US border stamps on my passport. Then she called my attention that I failed to include one overnight trip (which I truly cannot recall, maybe one of those crossings that went beyond 12 midnight) which was what I replied. She then said that because I had a few days buffer it wouldn't matter. To date, I am already scheduled for oath this coming October. So if that is your only worry, I think you will be fine.
