Hi all,
I have been travelling 3-4 times a year to the US by car. The first time I entered they stamped my passport and stapled the I-94 which was valid for 6 months, and every time I travel within the six months they don’t stamp my passport until the next issuance of I-94. I was able to pull out my entry/exit records from the US CBP website but I’m finding missing records. Will requesting FOIA for I-94 include these records or will I get the same result? How can I have these missing records included?

Thanks

What missing records you are missing? Are they entry records or exit records? What I can suspect would be exit records? Did you travel through land during those exits? If yes, then its a known issue: Read the following links for more clarification:

https://help.cbp.gov/app/answers/detail/a_id/752/~/i-still-have-my-i-94

https://help.cbp.gov/app/answers/detail/a_id/1674/~/report-departure-if-entering-by-air-and-departing-by-land

I suppose FOIA and i94 will bring same results however, I am not sure if someone in this forum has cross checked i94 and foia report

Yes all of my travels were by land when I had the I-94 and I did return back the I-94 towards the end of six months to the Canadian Border guys. I'm not concerned about exits because hopefully CBSA didn't miss any of my re-entry records. My concern is my entry records into the US which is my only proof of when did I enter the US (and leave Canada). One example is in 2013, I made a day trip to Buffalo for shopping in September but the I-94 records don't show that date, so assuming the Canadians have a record of my re-entry, there is no way I can prove I entered the US on the same day when I apply for my citizenship.

Do you have the CBSA records? If yes, try matching both. You can go to any Port of Entry/ Deferred Inspection site in USA to see if they can update your entry information. Try to call them first before you go. Check i94 FAQs for more info regarding this.

That is correct, there is no way you can prove you entered and left the US the same day. The reason is to the US, you technically never left if you re-entered within in a month. Its called automatic re-validation of temporary status. It applies to US visitors and students. The only way to prove that you actually entered the US is by surrendering the I-94 every time you left and obtaining a new one when you entered again.

You will need to find some other way to prove that you left and returned the same day.

No I don't have my CBSA records. I will try to go to any Port of Entry/ Deferred Inspection site in USA to see if they can update my entry information.

CanV:
What you said is technically right, but they do track your re-entries because I was able to pull out some re-entries during the period of time that I kept my I-94 without surrendering it. They even started including my entries and exits from/to US starting mid of 2014 when I pull out my I-94 record.

I see that you already applied for citizenship . Could you please tell me how did you obtain you records . and proved the date of your entry to the US.
I have to apply for citizenship . i am desperately waiting for you response.

Thanks,

Thanks,
You have only two options to obtain your entry record into the US.
Option 1:
https://i94.cbp.dhs.gov/I94/#/home
This option is not as accurate as option 2 but you can obtain those records instantly (up to 5 years ago only)

Option 2:
https://foiaonline.regulations.gov/foia/action/public/request/publicPreCreate
This option is more reliable and should have all of your records. You'll need to create an account snd submit the request online, but it may take several weeks to several months to obtain these records depending on your luck.

Good luck
