Hi Leon & Group Members

1. I have a PR Card which expires in November 2017 and do not meet residency obligations.
2. I have a valid work visa for USA for next 3 years and work for a Technology Giant with offices in Canada & USA
3. I currently live in USA near Toronto Border.
4. I will need to enter USA and back to Canada for work reasons.

Can I enter Canada using the following
1. Personal car bought and registered in Canada
2. Use my Indian Passport and Certificate of Permanent Residency after my PR Card expires.
3. I will be doing it atleast 5-6 times in a year until I meet 730 days to safely apply PR Card renewal.

Is this an option or too risky.

Hi

If you are able to enter Canada without being reported for failing to meet the RO, you need to remain here until you once again meet the RO. If you leave, you can pretty much count on being reported upon re-entry, which will result in the loss of your PR status.

It looks like you will need to choose between your PR status and your job.

Thanks for your insightful responses.I am in a situation where I don't meet the residency obligation and reside in USA on a non-immigrant visa.
Me and my Wife went through 5 years of medical treatments to expand our family and our doctors have given us letters which can be used for H&C grounds
Here is my situation
1. Work for a HiTech company willing transfer to Toronto Canada
2. Still 8 months left on PR Card
3. Can I report myself at the Border that I dont meet RO to expdite my hearing,
4. Is Medical treatment a reason enough for H&C
5. How long it may take to meet a Visa Officrr for judging my case

Given the fact that such medical treatments can be obtained in Canada, I believe you will have a hard time claiming H&C.

With a valid PR card you may be allowed entry without your RO coming up, although if you continue to cross the border odds are you will eventually be reported.

You can voluntarily report your RO violation, but I don't think it will make the process any quicker. Most people need to wait quite a long time (up to 2 years) before they get a formal hearing.

At least during this time, they can issue you a 1-year validity PR card which can be renewed as needed, to enter/leave Canada as you wait for hearing date.

As to medical reason qualifying, I have no idea in your case. It's best to talk with an immigration lawyer experienced in medical H&C issues.
