Hi i am sorry if this is the wrong area of the forum but im hoping someone may be able to guide me into the right direction. i cant afford a lawyer at the moment so im trying to get some advice. i am a canadian citizen living in europe at the moment with dual citizenship from greece. i left the states while on probabtion for a possession charge(narcotics) in california. i dont intent or want to go back to settle in the states. However i would like to go and settle back in canada. Should there be an issues in entering as a canadian citizen with an outstanding warrant from the states?

Any help would be appreciated.

It really depends if US law enforcement agencies have notified to Canadian authorities about your charges. If they have then you'll have to deal with the law once you are here in Canada otherwise you are a free man. The other alternative is to stay where you are for a long time and not worry about it.

thanks newtone. I do appreciate the reply. I guess the hard part is trying to find out if Canadian authorities would of been notified. I actually am not hiding. Im pretty sure family from the states have let the probation officers that called a few times mostly looking for my money that I owe them and were told where I now live. Because its drugs and a felony charge that lead to the probation that I did not finish im concerned. Do you think it would be better to contact a Canadian immigration lawyer or Canadian criminal lawyer to try and find out if im on any lists. im about to renew my passport from Europe so maybe that might be a logical check. if that goes through ok maybe then im ok. very stressfull but only myself to blame

1. There is probably a warrant on NCIC for your arrest in the US. CBSA has access to the NCIC.
2. It is possible on your entry that CBSA will notify the FBI that you have entered Canada.
3. It depends on the FBI on how badly they want you, if once they know you are in Canada, that they apply for an extradition warrant. (Takes time)
4. Criminal lawyer.

Me thinks it's not a good idea for you to ever come to Canada. Canada is like the USA's lap dog. It has a track record of voluntarily extraditing its own citizens to the USA. That is, Canadian citizenship is a joke.

You think that Canada should be a fair haven for criminals committing crimes outside Canada?

thanks for the replies. to be fair it was a crime but a victimless one. I had a drug problem and did complete a recovery program while on probation before I left. its just that I had to leave before my probation ended due to a family emergency abroad and that complicated things.

Do you really think the FBI would be involved in a state drug possession warrant? seems a little small time for them but I get what you are saying. I may be able to enter Canada but then what. it might be stressfull having to look over my shoulder all the time. is there a way to find out if im on that NCIC list?

If you left without completing probation then I think it's pretty safe to assume your name is on NCIC.

thanks Scylla but if that is true and I agree its likely it is as a Canadian citizen can Canadian border control deny me entry? im confident there is no international warrant for my arrest as I move freely in Europe. everything I read online is about canada denying entry of usa citizens and vice versa. im having trouble finding any info on my particular situation. if you have any advice please let me know.

thanks

No, as a Canadian citizen you can't be denied entry to Canada. If no extradition warrant is issued, fine. But I wouldn't go anywhere the US again if I were you.

sucre,

Pray that when flying to Canada that Toronto Pearson or the other relevant airport doesn't have any issues with flights diverted to the US where you would need to get off the plane....have you considered trying to get this resolved so you are not looking over your shoulder? It may not necessarily mean jail time.
