Hi Guys,if anybody here can please give some suggestions regarding my situation here. I am currently on work permit and visa that expires on 15 Feb 2014, i will be travelling to US in december and then returning back to canada in January, will i have any problems entering canada back, as my work permit would only be valid for a month or so by that time? Also, i have applied for for PR under CEC and still waiting for my medicals.

I guess it will be a problem as they have a valid reason to stop you and say it is just one month left. Its best to call service canada/cic and ask them. They are helpful

Should not have any problems - you have a valid TRV to enter the country and a valid WP providing you worker status and a reason to re-enter the country (presumed to continue employment). Get a letter from your employer (an employment verification letter - some call it) stating you currently employed, and will be on leave/vacation and will come back in January to resume work.

The only question remaining here for border officials, is given there is 1 month to go before the expiry, is there a risk that this person will contravene the authorized period of stay/work as given by the validity of the WP? If you are asked on the off-chance, this can be dealt with by explaining you have applied for permanent residency with the AoR as proof and will be applying for a BOWP to extend your current status as soon as you arrive.

My advise will be to put in an application for a BOWP before you leave for the vacation. You should be eligible, and by putting in an application for the BOWP, the gap between your WP expiry and the PR application (worker-permanent resident) is filled in - thus no questions on intent or perceived "risk" of you staying beyond the authorized period seen in your WP. The CBSA officer should see there is when you re-enter, and thus, you are well-covered for all eventualities.

It's not a problem at all. My husband entered Canada 20 days before the WP expiry. The officer only suggested us to apply ASAP if we want to extend his WP
