I have this urgent issue that I need your help with.

I am on a closed work permit until September 2014, I was laid off from work in March 2013 and I only applied for EI in June 2013, as my employer misinformed me that I can only apply for my EI after I receive my ROE (Record Of Employment) and since my discussions with regards to my lay off lasted a few months I was not given the ROE.

Anyways, I applied for EI in June 2013 and yesterday (July 18,2013), I was sent a letter stating that my EI has been REFUSED and the reason mentioned on this letter was "We are unable to pay you Employment Insurance benefits. Your employment authorization restricts you to working only for "my company's name" while in Canada. Because you are not allowed to work for any other employer, you are not considered available for work."

Now, I am in a severe dilemma as I can't find an employment because of the LMO issue and also, even though I have paid religiously into the EI system and all my hours of work are in perfect order, they have refused me of this benefit, when I desperately need this money.

Now, I have my rent to pay, the car insurance, i am so stressed that I don't know what to do. I was really looking forward to this money.

They have mentioned in the letter that i can appeal this decision within 30 days.

I need your help on what I should do. I am extremely stressed and cannot think right.
I spoke to a few EI agents on the phone, but they were very rude and dismissed me right away, they did not even empathize with me or my situation.

Is there anyone of you who was in my situation and yet got their EI in the last few months?

Please help.
 
First of all sorry for you job loss. This can happen to any one, I learn this very hard way. Can you give some details

1.Did you applied for PR under CEC ?
2.If yes, When you received your AOR?

Hi,

Sorry to hear that.

With PR application submitted, you can apply for BOWP, which will allow you to work for anyone for about 1 year until you get the PR>.
I am not sure if you have received AOR from your pR application, but i guess you can even apply without it. There were same cases like yours where people were laid off from work and applied for BOWP and got it.
Search this form for BOWP. By the time your BOWP is processed, AOR could be issued to you if you have not received it.

Wait till you receive your CEC AOR and apply for BOWP visa with showing AOR as proof. Once you receive BOWP, you will become eligible to work with any employer in Canada which should make you eligible to receive EI (as per the information provided by the EI). The only reason they mentioned that they cannot give the EI is that you are not eligible to work in Canada, and if that condition is removed you are eligible. Getting BOWP will help you in this situation. I am not an expert in this and you can check with other seniors.
 
I was told by someone (in this forum I guess) that you can re-apply for EI. Try that too

Am I the only one who thinks who you cannot apply for BOWP without AOR and 4 months before the expiry of your work permit?

Yes, I have already applied for PR-CEC in the beginning of this month and I am awaiting my AOR.

Well, Then wait for your AOR,...after that apply for BOWP and once u get it start searching for job and apply for EI.

They may be willing to consider special circumstances....attaching an explanation letter with details about your case can help. The person already has a work permit and is eligible to apply for PR....dont see why they wouldnt issue it. BOWP would supersede the previous permit, but only be for the length stated in OB 485 (1 yr). So, may shorten your work eligibility....but if you are confident in your PR application or ability to find work, but only need a bridge now, I would certainly do it. Just state your case and attach AOR in BOWP application and hope they have some understanding.
