Employer Closed Operations:How to prove employment

Hi ,

I am in the process of collecting documents for filling ITA.

My previous employer had gone bankrupt and the premises of the factory where my office was, has been sealed by the bank/law authorities. But company still exists on papers.

Facts about the case:

-Worked from Jan 2015 to May 2016.

-The company (factory) premises and operations got sealed in Dec 2016 .

-I used to get salary in cash so the receipts are also in that premises.


Query:

1) If they issue me a Reference Letter on present date i.e June 2017……is that letter valid?

2) Their letter head bears the factory premises address which has been sealed so there is no one to respond if there is a physical enquiry done……would this be a problem?

3) How do I prove that I used to draw salary from them……….I have their name and amount in my previous IT return copies…Thats the only proof I have……....would be sufficient to prove withdrawal of salary?

You can prove that in the following manner ~

1. You can get the letter from employer working at your same level or superior to you OR even if the one who is your head or the one which whom you report.
2. In that letter, ask him or her to put each and every required details like name of the company, your working hours per week, your salary (as it is known to him), your duties and responsibilities as well as clearly mentioning that the company is closed now because of XYZ reasons.
3. This letter will contain that person complete details ~ address, phone number and email id along with his or her signature of course.
4. Once you have this letter, get this notarized and you are done.

Getting a letter is not a problem.I can get a letter from my employer i.e. Director.He ready to give it even on the letter head.The letter will contain all his info:name,designation,phone.....

My only doubt is that the address mentioned on the letter head nowadays sealed by law authorities.So it wise to take a reference letter on such a letter head ?

If yes,
Should it be notarized?
How would my employment be authenticated as the premises where I worked is closed?

And you missed to guide on::: how to show that I was drawing salary from the employer ?

Well mine sister too is in the same scenario and she is going to get a letter from her team lead at the time when she was working in that said closed company.

The reason of closure is same - Government get it closed - legal complications.

The idea is same as I shared with you as this is what we read in the forum from other people over similar scenario.

Also for a safer side, do include letter of explanation for the same.

Your director need not to put it on letter head as his company was closed and putting and submitting anything now on letter head is technically not legally right.

Get it typed and print on regular A4 paper followed by signed and dated but remember not stamped as it is not legally right.

Just get the letter from the director on the letter head with all the required details along with the current status of the company(currently sealed, bankrupt etc). Get it notarized for good measure and attach the IT return documents that you have.

Notarized basically make the thing authentic.
Do you mean the ex CEO or manager or supervisor should go the lawyer or public notary to sign the emloyer letter front of them to get it notarized?
I will attach a proof of bankruptcy/company closure. This legal document shows many details, old adress, name of the owner...
I really hope it is enough.

Letterhead is not valid any more, why they should use that if they already out of business?

Well there are plenty of suggestions ....thanks!

But there is a bit a clarification in facts (which I got to know just today)

My employer's factory has been sealed....but THE COMPANY STILL EXISTS ON PAPERS. ITS HAS NOT BEEN DISSOLVED.


So as per my common knowledge:

- The director can still use the letter head to give me a reference letter with job duties and other details.

-If yes then I was just thinking to get one line added saying : The company work/operations have been suspended temporarily.Also mentioning the new contact details of my director ( i.e.former Boss) during working hours,as he sits at some other address.

-Not getting notarized.

Pls advise its fine to do so (under the light of the fact the company still exists (only closed wokring operations)
