Employed on crew while applying PR status

Hi guys,

So in the past few months we have decided to move to Canada. At the end of last year, my girlfriend (we have been together for 4.5 years, living together for 4 years next month) received her Canadian citizenship by descent. Needless to say, we decided that leaving our current country (South Africa) and moving to Canada would be life-changing and we decided to take the challenge. And boy, was I wrong when I thought it would be easy. Our first problem soon arrived when we realized she cannot sponsor me unless we can prove that she is going to move back to Canada. Naturally, this is a catch 22 situation since she has no family that side and they expect (I assume) that we have rental agreements and jobs in place already. I highly doubt anyone would offer us jobs when we ask them to keep said jobs until we arrive in Canada after a year or two! :)

Right, so we looked at option B - going over and applying from inside of Canada. I decided that I don't want to go on a TRV, since it just feels as if they would refuse me as soon as they found out I went on TRV then applied for inland sponsorship. So we came across another option! There are these fun fares where people get employed (for around $350 a week) for an entire year. It is legal and I dont have to lie. Now I was wondering, will I be able to get said carnival job (or maybe we can both get jobs at the same carnival) and still apply inland? Technically, we wont be living together that year since we will travel with the crew from one city to another, but its a great way to be in Canada for our first year without spending our savings while searching for jobs/waiting for my open work permit. We are looking at going over with about 15 000 dollars, to last us for 6 months (renting a room from somebody at the start).

Since we will be a crew and travel a lot, would CIC mind as long as we can give a permanent address for mail? We have some friends in Canada that wouldnt mind getting our mail. I think this is a good, honest way for me to be with her in Canada, get a starting job and getting used to the county's culture.

Another option would be to apply for holiday jobs at resorts etc. (meaning we wont travel from town to town every month). I have always wanted to work at a ski resort since I have never seen snow in my life. Will this be okay with CIC? We are not doing anything illegal then, and although our income would be minimum, it doesnt mean that either of us will end up in welfare. I have a degree in logistics and she has graduated high school. We are both in our 20's (I am 27, she is 23) and we are ready to take the journey and make it ours.

It is just too difficult to try and find employment from another country for her, and even if I get the open work permit soon after we land, I will still be on a TRV when I applied which would technically be illegal. If I apply while on a temporary work permit, it would just feel better. When said permit expires and the job also expires, I would at least have all my savings left and an open work permit (assuming my application is not done yet, which I believe wont be as it takes more than a year).

What do you guys think of the idea? Does anybody know of places that hire young adults from other countries? Thanks for taking the time to read my post! ;)

Hi

Regardless of whether you come to Canada as a visitor or worker, you will need a TRV. As the spouse of a Canadian citizen, it will be difficult for you to get a TRV. I suggest you try to apply for one before deciding on everything else. If you are refused, you will have no option but to apply outland.

If you are going to try to come to Canada as a worker, you will first need a job offer from an employer with an approved LMIA in order to apply for a work permit.

If you are applying inland, you are required to live together throughout the process.

It's fine as long as there is a mailing address.

Again, same process as above to apply for a work permit.

If you are able to come to Canada and apply inland, it will be about 4 months before you get the OWP.

I don't know why you think that. You can travel to Canada on a TRV, enter as a visitor and apply for PR. There is nothing wrong or illegal about this.

To qualify to apply for a work permit, you not only need a job offer in Canada but also an approved LMIA (this is something the employer has to obtain). I think the chances of getting an approved LMIA for a carnival job are effectively nil.

You must be physically living together if you plan to apply inland.

Thanks guys. The company sorts out the visas etc., it is only a holiday job (temporary) for one year. Basically the same type of job like those who work on cruise ships etc.

They responded and said they only employ people in America though, after their website clearly states Canada. Anyways, we are just trying to find ways to get some temporary employment upon landing. At the moment we are hoping to get my PR before landing, but if all else fails we will have to do TRV for me.

I thought that TRV is illegal, thank you for clearing it up for me. She is not my spouse yet, we decided not to get married yet because we have read that it may get my TRV refused? At the moment we are going for outland application. I am going to start a thread on "proof of intent" to hopefully find some people who have been in our situation. I have had some responses before on the topic, but hopefully there might be new people who may shed some light!
