My wife is a Canadian citizen and is sponsoring myself and my son for permanent residency (outside of Canada). We have been married for 7 years. We submitted our application by overnight courier on March 24. We have a confirmed delivery receipt for March 25. My son turned 22 on March 27. My understanding was that he would still qualify as a dependent child under 22 because our application was submitted before his 22nd birthdate.
In May, my wife received a notice from CIC that our application was missing form IMM 008 and that she had 45 days to resubmit it. We immediately printed off the completed IMM008 and resubmitted it. A recent call to CIC confirmed that they did receive it on May 15, and that is the date they will use for processing.
My question is, will the original date of receipt (March 25) be considered valid as to when our application was submitted, or will they reject my son's application because he was 22 years old on May 15?
I went through the checklist three times at Purolator before we placed ALL the forms in the package and handed it to the cashier. Reading through these forums, I've seen a number of people who have had forms lost at the processing center and been asked to resubmit them. Does anyone have any concrete examples or experience as to what is considered the 'official' date of an application where one or more forms from the original application package was missing or lost?
