when creating my EE profile, I answered NO to the statutory questions but the actual fact is that:
1. my spouse was the principal applicant in our earlier immigration application in 2003 before express entry started and the application was cancelled and returned..
2. I had gotten a visitor's visa to canada last 2 years but mistakenly thought that visa does not come under immigration refugees and citizenship
3. I was denied US visa renewal sometime ago but was later granted renewal

I have received ITA and I'm confused on whether to accept and explain with an LOE or to decline and hope to receive another ITA (my crs was borderline)

Kindly advise. Thanks a lot

I think they would probably give you a chance to explain by requesting the Schedule A form again. But if you don’t want to leave it to chance then it would be best you raise a CSE and explain yourself there. All the best.

He hasn't submitted yet. What is CSE for?

Best advise: Call CIC.
Moderate advise:
1. Adjust your mistakes in your eAPR application profile.
2. Write a LoE and attach to your eAPR profile

If you haven't submitted your eAPR as yet, you can change anything in the questionnaire as long as it doesn't affect your CRS Score - statutory questions don't affect your CRS Score and you would still have gotten an ITA anyway even if you had answered yes to those questions in your EE Profile.

Simply change the answers, attach a Letter of Explanation to explain points 1 and 3 (point 2 doesn't need explaining; you just need to answer 'Yes' to the question 'Have you applied to IRCC before?'). As recommended by Syed2808, go ahead and proactively complete and submit Schedule A, since it is likely you will get an 'Additional Document Request' for this because you're answering 'Yes' to some of the statutory questions.

Based on what you've outlined to us, answering 'Yes' shouldn't really have any negative bearing on your application - as long as you're honest and disclose everything, you should be fine.
